ARTICLE III. SOLID WASTE F'ACILITIES* <br />(2) Construction and operation of sanitary landfills, <br />(3) Construction and operation of waste burning facilities. <br />(4) Construction and operation of transfer stations, <br />(5) Construction and operation of solid waste processing facilities. <br />(Code 1982, § 604.06) <br />Sec. 58-'i22. Submission of application; review by city staff. <br />Page 6 of 23 <br />Applications to establish or operate solid waste facilities shad include all of the information, plans, reports, and <br />other materials required by this article and shall be filed with the city building and zoning administrator. City staff shall <br />conduct such review and investigation of the application as it deems necessary and may retain professional <br />consultants to assist in this process. If additional information or materials from fihe applicant are necessary to complete <br />this review and investigation, the applicant shall be so advised and shall provide the additional information or materials <br />before'review of the application will continue. <br />(Code 1982, § 604.10(1)) <br />Sec. 58-123. Fees. <br />(a) Application fee. The operator of a proposed solid waste facility to be located within the city sha8 pay an <br />application fee to the city in an amount equal to al- of the city's direct costs, including, without limitation, all <br />legal, planning, consulting, and engineering expenses, including a reasonable charge for city staff time, <br />incurred in: <br />(1) Reviewing and investigating the application for a license and conditional use permit for the <br />establishment and operation of the facility. <br />(2) Preparing the necessary license and conditional use permit. <br />The first $1,000,00 of the application fee shall be paid to the city at the time the application for a solid waste facility <br />license is filed. The balance of the application fee, if any, shall be paid by the applicant within 30 days of the <br />applicant's receipt of a statement from the city setting forth the costs incurred by the city and the amount due from the <br />applicant. The application fee required by this section shall be in lieu of, and not in addition to, any fee otherwise <br />required to be paid by the applicant to the city for the issuance of a conditional use permit. <br />(b) Annual license fee. Any operator of a solid waste facility within the city shall pay an annual license fee to <br />the city in an amount equal to all of the city's annual costs, including, without limitation, all legal, planning, <br />consulting, engineering, and inspection expenses, including a reasonable charge for city staff time, incurred in: <br />(1) Monitoring and inspecting the construction of the facility. <br />(2) Monitoring and inspecting the facili#y following construction and during operation. <br />(3) Administering and enforcing the license and conditional use permit. <br />The annual license fee shall be payable within 30 days following receipt by the operator of a statement from the city <br />setting forth the costs incurred by the city in the immediately preceding year and the amount due for the license fee. <br />Building permit fees, if any, paid by the licensee to the city shall be deducted from the license fee for the year in which <br />the building permit fees are paid. <br />(c) Volume-based fee. !n addition to the application fee and annual license fees required by subsections (a} <br />and (b) of this section, any operator of a facility for the disposal of mixed municipal solid waste located within <br />the city shall pay avolume-based fee on a per-cubic-yard basis of waste, or its equivalent, disposed of at the <br />facility in an amount as established by resolution of the city council. The revenue from this fee shall be credited <br />to the city's general fund. Pursuant to Minn.
