ARTICLE III. SOLID WASTE FACILITIES* <br />Page 7 of 23 <br />the fee shall be used only for purposes of landfill abatement or far purposes of mitigating and compensating <br />the local risks, costs and other adverse effects of such facilities. Revenue produced by the balance of the fee <br />may be used for any general fund purpose. Solid waste faciiify operators shall pay this fee on a monthly basis. <br />(Code 1982, § 604.08) <br />Sec. 5~-124. Review by council and planning commission. <br />Following completion of the staff review and investigation relating to the application for a solid waste facility <br />license, staff shall prepare a report on the application for review by the city council. The application and staff report <br />thereon may also be submitted to the city planning commission for review in connection with the planning <br />commission's consideration of a conditional use permit for the proposed facility. The city council shall review the <br />application at an open meeting of the council and shall evaluate the application in accordance with the standards and <br />requirements set forth in this article. <br />(Code 1982, § 604.10(2)) <br />Sec. 58-125. Action by council; standards for approval. <br />The city council shalt order the issuance of a requested solid waste facility license only if it finds and <br />determines that: <br />(1) All of the minimum requirements set forth in this article for the establishment of the proposed <br />facility have been met. <br />(2) Any additional requirements or conditions deemed necessary by the city council as provided in this <br />article for the establishment of the proposed facility have been met. <br />(3) The operation of the proposed facility will fully comply with ail of the performance standards <br />established by this article, the zoning regulations (chapter 30, article VI), and the remaining provisions <br />of this Code. <br />(4) The operation of the proposed facility will fully comply with any additional performance standards <br />or conditions deemed necessary and imposed by the city council as provided in this article. <br />(5) All of the requirements of the zoning regulations (chapter 30, article VI) for the issuance of a <br />conditional use permit for the proposed facility have been met and the standards for issuance of a <br />conditional use permit set forth in section 30-654(a) have been met. <br />(6) The proposed facility will be so situated, equipped, operated, and maintained as to minimize, to the <br />maximum extent possible, using the best available technology, any potentially adverse impacts on: <br />a. The environment. <br />b. Groundwater quality. <br />c. Aersans residing or working in the area. <br />d. Other land uses and activities in the area. <br />e. The use, enjoyment or value of any neighboring property. <br />f. The public health, safety, and general welfare. <br />(Code 1982, § 604.10(3)) <br />Sec. 58-926.
