ARTICLE ITT. SOLID ViTASTE FACILITIES* <br />Page 5 of 23 <br />(4) Fails to notify the city immediately of any violation of this article which exists at a facility licensed <br />pursuant #o this article. <br />(b) Any person within the city who violates this article, or who shall permit such a violation to exist on <br />premises under his control, or who shall fail to take action to abate the existence of a violation within a <br />specified time period when ordered or notified to do so by the city, shall be guilty of a misdemeanor, and upon <br />conviction thereof shall be punished therefor as provided by law. A separate offense shall be deemed <br />committed upon each day during or on which a violation occurs or continues. <br />(Code 1982, § 604.34(1), (2)) <br />Sec. 58-104. Dangerous waste. <br />(a) Application to dispose of, store, process, or burn dangerous wastes at a licensed solid waste facility in the <br />city shall be made to the city building and zoning administrator. The applicant shall submit such information <br />with respect to the dangerous waste as is required by the building and zoning administrator, including any <br />analysis of the dangerous waste done by the state pollution control agency, and any additional analysis or <br />(nformation required by the building and zoning administrator. <br />(b) The building and zoning administrator may: <br />(1) Grant the requested permission to dispose of, store, process, or burn dangerous waste, subject to <br />such conditions as the building and zoning administrator deems appropriate; <br />(2) Deny the request, setting forth in writing the reasons therefor; or <br />(3) Refer the request to the city council far review and decision on the request by the city council. <br />(c) A decision of the building and zoning administrator denying permission to dispose of, store, process, or <br />burn dangerous wastes, or imposing conditions on such disposal, storage, processing, or burning that are <br />unacceptable to the applicant, may be appealed by the applicant to the city council, by setting forth in writing <br />the reasons for the appeal. <br />(Cade 1982, § 604.20) <br />Sec. 58-105. Transportation of waste. <br />The collection and transportation of solid waste, including transportation to and from solid waste facilities, shall <br />be performed in accordance with article If of this chapter and Minnesota Rules 7035.0800. <br />(Code 1982, § 604.22) <br />Secs. 58-106--58-120. Reserved. <br />®IVISI®N 2. LICENSE <br />Sec. 58-121. Required. <br />No person shall make or allow his land or property under his control to be used for solid waste management or <br />disposal purposes except at a solid waste facility for which a license has been granted by the city council.
