11,9, Commercial Units. Commercial Units shall be benefitted by an easement for <br />access over the Common Elements by their respect tenants, customers and vendors; provided, <br />that such access shall be by the most direct route from the exterior of the building to the <br />Commercial Unit or Units. In addition, the, Commercial Units shall be benefitted by ant easement <br />over. the Common Elements for transporting trash and refuse to receptacles designated by the <br />Board for the disposal of such items; provided, that said easement shall be utilized in a manner <br />designed to Minimize any disturbance to other Owners' or Occupants' use of the Property and <br />may be limited by Ryles approved by the Board. The foregoing easements shall be subject to <br />reasonable riles established by the' Board, consistent with the oporational needs of the tenants of <br />the Commercial Units and the needs for quiet enjoyment by the Owners and Occupants of the <br />Residential Units. <br />11.10. Other. Easements, The Property shall be subject to such other easements as may <br />be recorded against the Property by reason of the City's requirements in connection with the <br />development of the Property. <br />11.11. ;Continuation., Scope and Conflict _of Easements. The easements set forth in this <br />Section (I*) shall run with the land and shall be appurtenant to the benefited. property, (ii) shall <br />supplament and not limit any easements described elsewhere in this Declaration, or otherwise. <br />recorded (i`i) s hall be permanent, subject only to termination in accordance with-the terns of the <br />easement; (iv) shall be subject to reasonable regulation by the Association and shall be subject to <br />such reasonable limitations as to location, and routing as may be established by the Association <br />or any goverm ental authority; and (v) shall include reasonable aocess to the easement areas over <br />and through the Property for purposes of constmetion, maintenance, repair, replacement and <br />reconstruction.. <br />11.1.2, Non In erference; _Irnpairmerit- _Prolaibite , All Persons exercising easement rights <br />shall i do so in a ^reasonable manner so as not to materially interfere with the operation of the <br />Property or cause damage to the Property; (ii) shall promptly repair any damage to the Property <br />which they or their employees or agents caused; (iii) be financially liable for all costs of repair of <br />any part of the Property which is damaged by the Person's exercise of the easement rights, and <br />Ov) hold harmless, indemify- and defend the Association and other Owners, and their officers <br />and directors, from and against all claims, damages, losses and other liabilities arising out 9f the <br />exercise of the easement rights. No Person shall impair, obstruct or cause damage to any <br />easement area, or Improvements or equipment installed therein. Notwithstanding anything in <br />this Declaration to the contrary, no Owner or Occupant shall. be denied reasonable access to his <br />or her Unit or the right to utility services thereto. <br />11.13. Benefit of Easements, -Alt easements benefiting a ,Unit shall benefit the owners <br />and Occupants of the Unit, and their.invitees. -However, an Owner who has delegated the right to <br />occupy the Unit to an Occupant or Occupants, whether by a lease or othemd e, does not have the <br />use and other easements rights in the Property during such delegated occupancy, except (i) as a <br />est of an Owner or Occupant, or (H) in connection with the inspection. of the Unit or recover <br />� y , <br />of possession of the Unit pursuant to law. <br />MPLS -word 202180.3 29 <br />
