SECTION 12 <br />C o.MPLUN CIS AND IEMEDI]E <br />Each Owner and Occupant, and any other Person offing or acquinng any interest in tho <br />Property, shall be govern.od by and comply with tho provisions of MCIOA, the Governing <br />Documents, the Rules, and such amendments thereto as may be made from' time to time, and the <br />decisions of the .Association. A. failure to comply shall entitle the Association to the relief set <br />forth in this . Section, in addition to the rights and remedies authorized elsewhere by the <br />Governing Documents or MCIOA.. <br />12,1. Entitlement . to Belief, 'Legal relief may be sought by the 'Association, at its <br />discretion, against any Owner, or by an owner against the .Association ' or another Owner, to <br />enforce compliance with the Gove'ning Documents, the Mules, MCIOA or the decisions of the <br />Association., However, no owner may withhold any Assessments payable to the Association, <br />nor take or omit other action M violation of the Governing Documents, the Rules or MCIOA., as <br />a pleasure to enforce such Owner's position, or for any other reason. <br />12.2. Remedies. In addition to any other remedies or sanctions, expressed or implied, <br />administrative or legal, the Association shall have the right, but not the obligation, �o implement <br />any one or more of the following actions against owners and occupants and/or their invitees, <br />who violate the provisions of the Governing Documents, the Rules or MCIDA. . <br />12.2.1. Cofnmence legal action for damages or equitable relief in any tout t of <br />competent jun"sdiction. <br />12.2.2. Impose late charges of up to the greater of twenty -five dollars, or fifteen <br />percent of the amount past due, for each past due Assessment or installment thereof, and <br />impose interest at the highest rate permitted by law accruing beginning on the first day of <br />the month after the Assessment or installment was. due. <br />12.2.3. In the event of default of more than thirty days in the payment of any <br />.Assessment or installment thereof, all remaining installmonts of Assessments assessed <br />against the Unit ownod by the defaulting Owner mad be accelerated and shall then be <br />payable in full if all delffiquent Assessments or installments thereof, together with all <br />attorneys' fees and other professional fees, costs and late Charges, are not paid in full, <br />nor to the effective ,date of the acceleration. Not less than ten days advance written <br />notice of the effective slate of the acceleration, shall be given to the defaulting owner, <br />12.2.4. Impose roason.able flues, penalties or - cha.rgos for each violation. of <br />MCIOA., the Governing Documents or the Rules. <br />12.2.5. Suspend the rights of any owner or ocicupant, or heir invitees, to use <br />any Comnonlerrien amenities; provided, that the suspension of use rights shall not <br />apply to Limited' Conramon Elements allocated to the Unit, and, those portions of the <br />Common, dements providing utilities service and access to the Unit, Such suspensions <br />shall be limited to periods of default by such Owners and Ocoupanfs in their obligation's <br />imder the Governing Documents, and for up to one year thereafter, for each violation. <br />MPLS -Word 2021$0.3 30 <br />
