7.10.7. An Owner who causes an Improvement to be made, regardless of <br />whether the Improvement is approved by the Board, shall be solely responsible for the <br />constmetion standards and specifications relating to the Improvement, and for the <br />consttuction'work. The Owner, and not the Association, is responsible for determining <br />whether any. Improvement is in- compliance with any requirements imposed by any <br />governmental authority having jurisdiction over the Property. The Owner shall hold <br />harmless, indemnify and defend the Association, and its officers and directors, from and <br />against any expenses, 'claims, damages, losses or other liabilities, including without <br />limitation attorneys' fees and other professional fees and costs, arising out of (i) any <br />Improvement which violates any, govermnental laws, codes,' ordinances or regulations <br />(H) the inadequacy of the specifications for construction of the Improvements; or <br />(iii) defects in the construction of the Improvements, <br />7.11. 0niet En' o ent. All Owners and occupants and their guests shall have a right <br />off' quiet enjoyment in their respective Units, subject to the rights of (i) other owners and <br />Occupants to reasonable use of their respective Units and to the normal and customary sights, <br />sounds, odors and activity generated thereby given the -residential and commercial living <br />environment associated with the nature and stracture of the Buildings, and (?i) the Owners and <br />Occupants of the Commercial Units to conduct their respective businesses in a manner <br />customary for such businesses and to the normal and customary sights, sounds, activities and <br />odors. which are generated from the operation and patronage of such businesses, including <br />without, limitation restaurant and outdoor dining facilities. Subject to the foregoing <br />considerations, owners and 00cupants shall use the Property in such a manner as will not cause <br />a nuisance, nor unduly restrict, interfere with or impede the use and quiet enjoyment of the <br />Property by other Owners and Occupants and their guests. <br />7.12. Prohibited Conduct No Owner or Occupant shall (i) cause or permit any Physical <br />changes to heir Unit that could jeopardize or impair the weather -tight soundness or safety of a <br />Building, an-y' Building system, or other Improvement located on the Property; (R) interfere with- <br />any <br />easoment� (iii) install or permit the installation of Bard surface floor coverings within a <br />a <br />Ro�idential Unit wifhout the prior written, authorization of the Board, except for the replacoment <br />of floor coverings of sane type as originally installed in the Unit; or (iv) cause or permit any <br />g . <br />physical changes to a Residential Unit which could damage or otherwise affect 'y common <br />wall, floor or ceiling surrounding a Residential Unit, or the sound barriers or soimd attenuation <br />matel7als iinstall6d on or within the ceilings, floors or walls surrounding the Unit without the <br />prior written authorization. of the Board. <br />7,13. Cm-pli ce_wxth Law. No use shall be made of the Property which would violate <br />an y then e rmu.n <br />'ex icipal codes or ordinances, or state or federal laws', nor shall any act or use <br />be permitted which could cause waste to the Property, cause a material increase in insurance <br />rates on the Property, or otherwise cause any unusual liability, health or safety risk, or expense, <br />for the Association or any owner or Occupant. <br />7,1 4, Development Agreement. The Property is subject to a Development Agreement <br />It <br />by and between - the. original declarant and the City.
