Following action by the Planning Commission, the <br />City Council shall consider the .preliminary plat. <br />The City Council shall make its decision on the <br />preliminary plat within one hundred twenty (120) <br />days following receipt by the City of the <br />properly completed application, unless the <br />subdivider consents on the record to a <br />continuance. The City Council may: <br />1) Grant approval of the .preliminary plat, <br />with or without modification or conditions; <br />or <br />2} Refer the preliminary plat to the Planning <br />Commission or appropriate City staff, <br />officers or departments for further <br />• investigation; or <br />3) Deny .preliminary plat approval. If the <br />.plat is denied, the City Council shall <br />state the reasons for denial on the record. <br />x. Following preliminary plat approval, the <br />subdivider may petition the Council for <br />installation of the streets and other public <br />improvements required for development of the <br />subdivision. The petition shall be in the form <br />required by the City and shall be submitted with <br />a .cash escrow in the amount of the cost of the <br />feasibility study- for the .improvements, as <br />estimated by the City Engineer. Once the <br />petition and escrow have been received, the <br />.Council may order the feasibility report. <br />C. Final Plat <br />i. Following approval of the preliminary plat, the <br />subdivider may file an application for approval <br />of a final plat for all or a portion of the <br />• preliminary plat. The application shall be on a <br />form required by the City and shall be <br />10.22 <br />
