CITY OF ELK RIVER

LEAVES OF ABSENCE

The City of Elk River (the City) may grant an unpaid leave of absence if justified by
illness, accident, or compelling personal reasons, or as required by law. When a leave of
absence is granted, it usually is on the premise that regular employment will resume
when the absence is no longer required. Other than leaves required by law, a leave of
absence is a privilege, not a right, and is granted at the discretion of management.

All leaves of absence must be discussed with and approved by an employee's immediate
supervisor, the Department Head and the City Administrator. Forms for requesting a
leave of absence are available from the finance department. When possible, advance
notice of a leave should be provided to an employee's Department Head so work
schedules can be adjusted accordingly.

The following Leaves of Absence are currently observed by the City. The leaves of
absence are unpaid unless otherwise indicated in the Policy.

Family and Medical Leaves

Family and Medical Leaves covers the following types of leaves of absence:

Leave of absence for personal illness (Medical Leave)

Leave of absence for the illness of a family member (Family Leave)

Leave of absence related to the birth or adoption of a child (Parental Leave)

The policy set forth below addresses the fundamentals of the City's policies regarding
these various types of leaves in accordance with the federal Family and Medical Leave
Act. Certain circumstances may require special interpretation of the policy or involve
application of laws other than the federal Family and Medical Leave Act. As it is
impossible to anticipate every circumstance which might arise under the policy,
employees are encouraged to contact the Finance Director if they believe that the policy
description below is inapplicable in whole or in part to their specific circumstances.

Unless otherwise required by law, the combined total of available leave under this policy
is 12 weeks in any 12-month period measured backward from the date an employee uses
the Family or Medical Leave. Employees must include any available paid compensatory
and vacation time in the 12-week period allowed under these policies, unless otherwise
