indicated below. Employees must include any available paid sick, compensatory, and <br />vacation time for a Medical Leave. Employees may retain one week (40 hours) of <br />vacation or compensatory time if so desired. Unless otherwise required by law, no <br />benefits accrue during an unpaid Family or Medical Leave of Absence, although such a <br />leave does not constitute a break in service for purposes of eligibility for pension and <br />retirement benefits. Accrued vacation or other paid time off may not be used to extend a <br />leave of absence beyond 12 weeks. <br /> <br />Medical Leave of Absence <br /> <br />An unpaid Medical Leave of Absence will be provided in accordance with the Family and <br />Medical Leave Act of 1993 to any employee who has a serious health condition that <br />makes the employee unable to perform the functions of his or her job. A "serious health <br />condition" means an illness, injury, impairment, or physical or mental condition that <br />involves: <br /> <br />· inpatient care in a hospital, hospice, or residential medical care facility; <br />· a period of incapacity (inability to work, attend school or perform other regular daily <br /> activities) of more than three (3) consecutive calendar days that also involves <br /> continuing medical treatment; <br /> · any period of incapacity due to pregnancy or prenatal care; <br />· any period of incapacity or treatment for such incapacity due to a chronic condition <br /> which requires periodic treatment, continues over an extended period, and may cause <br /> episodic rather than a continuing period of incapacity; <br />· any period of incapacity which is permanent or long-term due to a condition for which <br /> treatment may not be effective but for which the individual is under the continuing <br /> supervision of a health care provider; or <br /> any period of absence to receive multiple treatments, including any period of recovery <br /> therefrom, for restorative surgery after an injury or for a condition that would likely <br /> result in a period of incapacity of more than three consecutive days in absence of the <br /> treatment. <br /> <br />Accrued vacation and other paid time off may not be used to extend a medical leave of <br />absence beyond 12 weeks. <br /> <br />It is required that a medical leave of absence and a Worker's Compensation leave of <br />absence run concurrently. <br /> <br />Eligibility <br /> <br />To be eligible for a Medical Leave, an employee must have been employed by the <br />City as an employee for at least 12 months and must have at least 1250 hours of <br />service during the year preceding the start of the leave. Hours of service are <br />defined as the number of hours actually worked and do not include either paid or <br />unpaid leave taken by the employee during the previous 12-month period. <br /> <br /> <br />
