City Council Minutes <br />November 18, 2002 <br />............................. <br /> <br />Page 10 <br /> <br />Mayor I~inzing opened the public hearing. <br /> <br />Bob Hall, owner of 7 and 23 3rd Street, Pineview apartments, and 337 Baldwin <br />Avenue, River Garden Apartments. He noted that both of these properties are adjacent to <br />the re-zoning site. Mr. Hall reminded the Council of a petition of over 100 names that had <br />been submitted on June 23. He noted that the petition objected to the rezoning because it is <br />a residential area and the rezoning would result in traffic concerns related to congestion and <br />safety issues. Mr. Hall suggested that the Council keep the zoning as it is with a Conditional <br />Use Permit required for uses that would compliment a residential area. <br /> <br />There being no further business, Mayor I~inzing closed the public hearing. <br /> <br />Mayor I~inzing indicated that she could not support a commercial use for the area while it <br />is still a residential neighborhood. Mayor I~inzing stated that the Council has not <br />considered all of its options. <br /> <br />Councilmember Tveite indicated that the area has essentially been operating as a C3 use and <br />stated that it should be zoned C3. Councilmember Dietz concurred with Councilmember <br />Tveite. Councilmember Motin indicated that he has some concerns due to the current <br />restraints of surrounding residential property. He further indicated that the property should <br />be zoned C3 and feels the entire area should be reviewed by the Comprehensive Plan Task <br />Force. <br /> <br />Discussion was held regarding the possibility of placing a moratorium on the site until it can <br />be studied. <br /> <br />COUNCILMEMBER TVEITE MOVED TO APPROVE A ZONE CHANGE <br />FROM R4 TO C3. COUNCILMEMBER DIETZ SECONDED THE MOTION. <br />THE MOTION FAILED 3-2. COUNCILMEMBERS KLINZING AND MOTIN <br />OPPOSED. (This motion takes a 4/5 vote to pass). <br /> <br />COUNCILMEMBER MOTIN MOVED TO PLACE A MORATORIUM ON THE <br />ENTIRE AREA NORTH OF MAIN STREET, SOUTH OF 5TM AVENUE, WEST <br />OF TWIN LAKES ROAD AND EAST OF 169 UNTIL THE MATTER CAN BE <br />REVIEWED BY THE TASK FORCE FOR THE COMPREHENSIVE PLAN <br />AND THE PLANNING COMMISSION. <br /> <br />Counselor Wilson noted that it would be best to table the zone change motion and then <br />request the Planning Commission review the moratorium issue. <br /> <br />COUNCILMEMBER MOTIN WITHDREW THE MOTION. <br /> <br />COUNCILMEMBER MOTIN MOVED TO RECONSIDER THE MOTION TO <br />REZONE THE PROPERTY. COUNCILMEMBER TVEITE SECONDED THE <br />MOTION. THE MOTION CARRIED 4-1. COUNCILMEMBER DIETZ <br />OPPOSED. <br /> <br />COUNCILMEMBER MOTIN MOVED TO TABLE THE MOTION TO <br />REZONE FOR A PERIOD OF NOT MORE THAN SIX MONTHS AND <br />DIRECTING THE COMPREHENSIVE PLAN UPDATE TASK FORCE TO <br /> <br /> <br />
