The Paroles Agree as Follows: <br /> <br />A~reement <br /> <br />1.2 <br /> <br />TerTrl <br />This agreement is effective upon execution and approval by appropriate NCDA, <br />Mn/DOT and State of Minnesota officials, and will remain in effect until it is <br />terminated by either the mutual assent of all parties or pursuant to article 1.2. <br />Tkis agreement, or a party's participation in this agreement, may be terminated as <br />follows: <br />A: NCDA may terminate its participation in this agreement by giving 60 days <br /> written notice to Mn/DOT. Dissolution of NCDA pursuant to applicable law <br /> will be deemed a termination of NCDA's participation in this agreement. <br />B. Mn/DOT may terminate this agreement on 60 days written notice to NCDA. <br /> <br />2. Designation of Mn/DOT as Lead Agency, Mn/DOT Duties <br />Pursuant to Minr~esota Statutes section 174.82-, Mn/DOT is the Lead Agency for all <br />commuter rail activities. As such, Mn/DOT's duties and responsibilities are to: <br /> <br />2.1. Ensure consistency in commuter rail activities and to coordinate commuter rail <br /> activities with regional transit plans developed by the Metropolitan Council and <br /> the St. Cloud Metropolitan Planning Orgarfization. <br /> Seek state and federal funding, including federal "full funding" grants, for <br /> commuter mil activities. <br /> Be the recipient and grantee of all state and federal funding, including federal <br /> "full funding" grants, for commuter rail activities. - <br /> Be the Responsible Governmental Unit, in parmershil~ with NCD& for l:iurposes <br /> of all Environmental Impact Statements related to commuter rail activities. <br />2.4 Negotiate with railroad companies for the use of milroad facilities and services <br /> necessary for commuter rail activities. <br />2.5 Review, for conformance with the System Plan, and approve each stage'of <br /> NCDA's commuter raiI planning, including I) feasibility studies, 2) planning, 3) <br /> preliminary engineering 4) final design, 5) construction, and 6) operational <br /> planning, including acquiring rolling stock <br />2.6 Respond to requests for approval submitted by NCDA, pursuant to article 3.7 of <br /> this agreement, no later than 30 days after receipt of the request. <br />2.7 Designate a Mn/DOT official to serve as a non-voting advisor to NCDA's <br /> "executive committee", or equivalent policy committee responsible for planning <br /> and developing commuter rail. <br />2.8 Designate a Mn/DOT official to serve as a non=voting advisor to NCDA's <br /> "technical advisory committee", or equivalent technical committee, responsible <br /> for overseeing the engineering, specifications and other technical aspects of <br /> commuter rail. <br />2.9 Provide NCDA with standards, forecasting models and other relevant data. <br /> applications and planning tools which will promote uniformity in corridor planning. <br /> <br />2.1 <br /> <br />'2.2 <br /> <br />2.3 <br /> <br /> <br />
