Number 80272 <br /> <br />AGREEM]ENT FOR COORDINATION <br /> OF COM]MUTER RAIL ACTIYITI[ES <br /> <br />Parties <br /> <br />This Agreement is entered into by the Commissioner of the Minnesota Department of <br />Transportation ("Mn/DOT") and Northstar Corridor Development Authority ("NCDA"), <br />a Joint Powers Board for the "Northstar Corridor". NCDA is studying and developing a <br />potential commuter rail corridor. <br /> <br />Recitals <br /> <br />Mn/DOT is authorized to enter into this agreement by Minnesota Statutes {}174.82; and <br /> <br />NCDA is a Joint Powers Board created under, and authorized to enter into this <br />agreement, by Minnesota Statutes {}471.59; and <br /> <br />Mn/DOT is responsible, pursuant to Minnesota Statutes {}174.82, for all aspects of <br />planning, developing, constructing, operating and maintaining commuter rail, including <br />system planning, advanced corridor planning, preliminary engineering, final des!gn, <br />construction, negotiating with raikoads and developing financial and operating plans; and <br /> <br />Mn/DOT must ensure~ pursuant to Minnesota Statutes § 174.84 (subd. 4), that Commuter <br />rail facilities are planned, designed and implemented in such a way as to move tran.~it <br />users to, from and within the metropolitan area, and to provide a unified, inte~ated and <br />efficient multimodal transportation system with rail transit lines that interface with each <br />other and wkh other transportation facilities; and <br /> <br />Mn/DOT has developed and published, pursuant to Minnesota Statutes {}174.84 (subd. 1), <br />the "Commuter Rail System Plan" ("System Plan") to govern and guide development of <br />commuter rail in Minnesota; and <br /> <br />NCDA will assist in the implementation of the System Plan and desires to receive federal <br />and state funding through Mn/DOT for activities conducted pursuant to the System Plan; <br />and <br /> <br />M.nTDOT and NCDA will c6ordinate commuter rail activities in such a manner as to <br />permit Mn/DOT to perform its statutory responsibilities; and <br /> <br />MnTDOT and NCDA will coordinate commuter rail activities in such a manner as to <br />enable commuter rail projects to qualify for and receive federal funding. <br /> <br /> <br />
