<br />Case File: 06-03 <br />Page 6 <br /> <br />Liberty Heights Estates <br />Preliminary Plat <br /> <br />19. A letter of credit in the amount of 100% of the cost of the improvements shall be submitted <br />prior to the releasing of the Final plat for recording. <br />20. The land use and bulk regulations for the subject property shall be incorporated into the <br />Zoning Ordinance for administration purposes. This shall be completed prior to release of <br />the initial Final Plat. <br />21. The applicant shall execute a developer's agreement outlining the terms and conditions of <br />approval for the Final Plat. <br />22. All required subdivision/park information shall be provided in an electronic format (.dwg <br />file) as required by the City Ordinance and Land Use Application prior to recording of the <br />plat. <br />23. Before the Final Plat of a second phase is approved, the Wetland restoration shall be <br />completed, the northern park property and the school parcel shall be graded generally flat <br />and seeded. <br /> <br />Staff also recommends authorization from the City CO,uncil to complete discussions with the <br />developer regarding the protective covenants and Planned Unit Development Agreement, the later <br />to be approved by the City Council in the coming months. <br /> <br />Conditional Use Permit. Staff recommends approval of the Conditional Use Permit, allowing the <br />property to be rezoned to PUD. <br /> <br />Zone Change. Staff recommends the property be rezoned to PUD, subject to approval of the PUD <br />Development agreement. <br /> <br />Land Use Amendment.
