<br />7. Develop minimum building design or "character criteria"
<br />ACTION: The Developer has prepared a draft outline of the anticipated covenant issues,
<br />attached. Staff requests Council authorization to further 'flesh out" the character criteria
<br />with the developer, assuming that the Council is pleased with the proposed layout. Much of
<br />this criteria will be memorialized in the PUD agreement, to be approved by the City Council.
<br />Staff further suggests that

<br />8. Current lot number generally acceptable, although noted that some lots would be lots with
<br />recommended changes.
<br />ACTION: The revised plan shows 449 lots, including the one school lot. This represents a
<br />loss of 3 lots, apparendy for the formation of the south side park.
<br />
<br />Recommendation
<br />The Planning Commission reviewed the conditions recommended by staff, and after discussion,
<br />forwarded 21 recommended conditions, should the Council desire to approve the Plat (as proposed
<br />on plans dated October 30, 2006), Conditional Use Permit, and Rezoning to Planned Unit
<br />Development. These conditions can be found in their entirety in the Staff memo dated December
<br />4, 2006.

<br />Staff recommends approval of the Preliminary Plat, as illustrated on plans dated January 30, 2007,
<br />subject to the following conditions:
<br />
<br />1. Approval of a Conditional Use Permit, authorizing the property to be rezoned.
<br />2. Rezoning approval from R-la to PUD
<br />3. The 29.75 "School property" acres shall be dedicated to the City, to be used for future
<br />school building. Should the School district not use the property, the City shall retain
<br />ownership for park and recreational uses.
<br />4. All comments and conditions -of the City Engineer's memo dated November 9, 2006 shall be
<br />addressed.
<br />5. All comments and conditions of the Sherburne County memo dated August 18, 2006 shall
<br />be addressed.
