The right of <br />way along CH 40 is 50 feet a'nd has been satisfied with Sherburne County Right of Way Plat <br />No. 30. The proposed 18th Avenue access to CSAH 40 has been approved in the proximity <br />indicated on the drawing. If trails are proposed or planned within or adjacent to County <br />Highway right of way, ten additional feet are required. To minimize noise and fast traffic <br />complaints, we recommend increasing the required building setback from the county highway. <br /> <br />This proposed 187th Avenue access and required right turn lane have not been incorporated <br />into the CH 40 construction plans and are not scheduled to be constructed. The grading <br />operation for the construction is under way and will be 95% completed this fall. It is possible to <br />incorporate the construction of this right turn lane into our project, if the developer agrees to <br />compensate the County for the necessary additional work and materials. Engineering staff <br />determined the estimated costs for the additional work and materials, including restoration <br />(based on the contract bid price) to be $9200. <br /> <br />If the developer chooses this option, he must field locate the access point of 187th Avenue. We ' <br />must receive notification and payment of $9200, before the contractor reapplies the topsoil. <br />The County will then construct the additional length and width necessary for the right turn lane <br />as part of the road project. Our work will include the class 5 gravel base, the bituminous and <br />restoration. . <br />
