The right of way along CH 40 is 50 feet a'nd has been satisfied with Sherburne County Right of Way Plat No. 30. The proposed 18th Avenue access to CSAH 40 has been approved in the proximity indicated on the drawing. If trails are proposed or planned within or adjacent to County Highway right of way, ten additional feet are required. To minimize noise and fast traffic complaints, we recommend increasing the required building setback from the county highway. This proposed 187th Avenue access and required right turn lane have not been incorporated into the CH 40 construction plans and are not scheduled to be constructed. The grading operation for the construction is under way and will be 95% completed this fall. It is possible to incorporate the construction of this right turn lane into our project, if the developer agrees to compensate the County for the necessary additional work and materials. Engineering staff determined the estimated costs for the additional work and materials, including restoration (based on the contract bid price) to be $9200. If the developer chooses this option, he must field locate the access point of 187th Avenue. We ' must receive notification and payment of $9200, before the contractor reapplies the topsoil. The County will then construct the additional length and width necessary for the right turn lane as part of the road project. Our work will include the class 5 gravel base, the bituminous and restoration. .
