ALSO, <br />THIS WILL MINIMIZE VEHICLES CUTTING THE CORNER AS <br />THEY COME IN TO THE SITE WEST BOUND. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br /> <br />The Planning Commission unanimously recommended approval of the <br />conditional use permit and variance request. However, the <br />Commission was concerned about vehicles leaving the drive-up <br />window and asked the City Engineer to review the traffic <br />circulation and possible problems that may arise. Attached is <br />Mr. Maurer's memo addressing the traffic issue. <br /> <br />The Planning Commission recommended approval of the conditional <br />use permit and variance request with the following conditions: <br /> <br />Conditional Use Permit <br /> <br />1. B612 CONCRETE CURB AND GUTTER BE PROVIDED ALONG THE <br />WESTERLY PARKING AREA. <br /> <br />2. SETBACK AREA ON NORTH SIDE OF NEW DRIVEWAY BE SODDED. <br /> <br />3. <br /> <br />A DRAINAGE PLAN FOR ALL NEW PARKING AREAS <br />SUBMITTED FOR APPROVAL BY THE CITY ENGINEER. <br /> <br />BE <br /> <br />4. EASEMENT DOCUMENTS FOR NEW DRIVEWAY BE EXECUTED AND <br />RECORDED WITH SHERBURNE COUNTY. <br /> <br />5. THE TRAFFIC FLOW BE APPROVED BY THE CITY ENGINEER <br />PRIOR TO THE CITY COUNCIL MEETING. <br /> <br />6. THE APPROVAL OF THE CONDITIONAL USE PERMIT BE <br />CONTINGENT UPON THE APPROVAL OF THE ASSOCIATED <br />VARIANCE REQUEST. <br /> <br />Variance Request <br /> <br />1. THE NEW PARKING AREA IS A LOGICAL EXTENSION OF THE <br />EXISTING PARKING LOT. <br /> <br />2. THE VARIANCE WILL NOT AFFECT THE HEALTH, SAFETY, OR <br />WELFARE OF RESIDENTS OR BUSINESSES IN THE COMMUNITY. <br /> <br />3. LITERAL APPLICATION OF THE ORDINANCE WOULD DEPRIVE <br />THE APPLICANT RIGHTS ENJOYED BY OTHER PROPERTIES WITH <br />SIMILAR CONDITIONS, THEREFORE, RESULTING IN AN UNDUE <br />HARDSHIP UPON THE APPLICANT. <br /> <br />4. <br /> <br />THE SPECIAL CONDITIONS ARE UNIQUE TO THE PROPERTY AND <br />NOT CHARACTERISTIC OF OTHER PROPERTIES. <br />
