<br /> <br /> <br /> <br />Planning Commission Minutes <br />June 28, 1982 <br />Page Eight <br /> <br />ZONE CHANGE REGUEST BY MR. CHIP MARTIN FROM 1-2 TO C-3. CO}lliISSIONER PEARCE <br />SECONDED THE MOTION. THE MOTION PASSED 5-0. <br /> <br />9) Consider Zone Change Request - Clarence Cook <br /> <br />Mr. Tony Trimble, attorney representing Mr. and Mrs. Cook, presented the request <br />for a zone change from R-lc to R-3. Mr. Trimble indicated that the property in <br />question is on the corner of 5th Street and Line. Mr. Trimble also indicated <br />that the area is currently surrounded by zones of M-R. The Cooks are asking <br />for the northern portion of their property to be rezoned to R-3, a piece of <br />1.1 acres, to construct townhouses. Mr. Rick Breezee stated that the M-R was <br />on the land use map and not the zoning map. The zoning map shows the area as <br />single family residential. <br /> <br />Discussion followed regarding the setbacks and the proper use of the land in <br />question. Mr. Trimble indicated that Parcel A, B, and C would be one lot. <br />Mr. Trimble indicated what type of construction that would occur on this piece <br />of property - to\vuhouses. <br /> <br />COMMISSIONER PEARCE MADE A MOTION TO RECOMMEND TO THE CITY COUNCIL DENIAL OF THE <br />ZONE CHANGE REQUEST BY MR. AND MRS. CLARENCE COOK, 429 LINE, ON THE BASIS THAT <br />THE CITY PLANNER HAS INDICATED THAT THERE IS ENOUGH R-3 ZONED IN THE CITY OF <br />ELK RIVER. COMMISSIONER KREUSER SECONDED THE MOTION. THE MOTION PASSED 5-0. <br /> <br />Commissioner Gunkel indicated that she would like to work something out regarding <br />C-3 zones at the next workshop. <br /> <br />Mr. Tony Trimble indicated that they have one parcel R-lc right in the midst <br />of a residential are~. Mr. Trimble further indicated that the single parcel <br />owned by the Cooks was zoned R-lc and as it is zoned presently, it was of no <br />use to the Cooks. <br /> <br />Zack Johnson asked Mr. Trimble if he was saying that the Cooks could not develop <br />it as R-lc? <br /> <br />Mr. Trimble indicated to Mr. Johnson that it could only be developed as single <br />family houses, the way it is zoned now. <br /> <br />Zack Johnson asked Mr. Trimble why the Cooks couldn't put single family houses <br />on this property. <br /> <br />Mr. Trimble indicated he didn't understand the logic of doing that. <br /> <br />Zack Johnson indicated that the entire block was zoned R-lc. <br /> <br />MOTION BY COMMISSIONER JOHN PEARCE TO RECOMMEND TO THE CITY COUNCIL DENIAL OF <br />THE ZONE CHANGE REQUEST BY MR. AND MRS. CLARENCE COOK, 429 LINE. THE MOTION <br />WAS SECONDED BY COMMISSIONER ESTELLE GUNKEL. THE MOTION PASSED 5-0. <br /> <br />10) Consider Conditional Use Permit Request - Jan McLean <br /> <br />Commissioner Gunkel asked Ms. McLean what the building was that would house <br />the styling shop? <br />
