<br /> <br /> <br /> <br />Planning Commission Minutes <br />June 28, 1982 <br />Page Seven <br /> <br />Zack Johnson indicated that if the unit remains moveable, then it is considered <br />a mobile home. Zack Johnson also cautioned the Planning Commission on making the <br />definition of a mobile home to include an architechtural review. <br /> <br />MOTION BY COMMISSIONER PEARCE TO RECOMMEND TO THE CITY COUNCIL DENIAL OF THE <br />CONDITIONAL USE PERMIT REQUEST FOR A MOBILE HOME LOCATED AT 21680 MEADm?VALE ROAD <br />IN THAT IT DOES NOT FIT INTO THE CITY CODE. THE MOTION WAS SECONDED BY COMMISSIONER <br />GUNKEL. THE MOTION PASSED 3-2, COMMISSIONER KREUSER AND FREDERICKSEN ABSTAINING. <br /> <br />8) Consider Zone Change Request - Chip Martin <br /> <br />Chip Martin was present to present his request for a zone change from 1-2 to C-3 <br />for his property kno\vu as Martin's Plaza on Highway 10 and the adjacent area. <br /> <br />Commissioner Pearce indicated that the Planning Commission should look at rezoning <br />more than Mr. Martin's property, possibly including the residential property around <br />his property. Commissioner Pearce also felt that it wasn't right to rezone this <br />prope.rty \vithout the people kno\ving about it. <br /> <br />Chairman Tracy indicated that if this area was rezoned, it would put the feed mill <br />and the homeowners in a nonconforming position. <br /> <br />Commissioner Gunkel asked Rick Breezee why this would include more than Mr. <br />Martin's area. Rick Breezee indicat~d"that st~ff had looked at the whole "set <br />upt., and that the HRA suggested looking at the \vhole area. <br /> <br />Chairman Tracy indicated that this area is a very narrow strip of property. <br />If the Planning Commission was to approve a change from 1-2 to ~-3, and if Mr. <br />Martin wanted to build on this narrow strip, the Planning Commission would also <br />be saying "yes" to a variance. <br /> <br />Chip Martin indicated that the way the land is zoned currently, it could never <br />be sold. Mr. Martin further indicated that he plans to continue to use this area <br />as a retail area. Mr. Martin also indicated that he had rebuilt his area known <br />as Martin Plaza in 1976 after a fire and at that time it was zoned retail. <br /> <br />Commissioner Pearce indicated that questions about future uses, at this time, <br />were hypothetical. <br /> <br />Commissioner Gunkel asked if this was a zone change and if it was, would a public <br />hearing be held? <br /> <br />Rick Breezee indicated that the City Council holds the public hearing, not the <br />Planning Commission. <br /> <br />Commissioner Pearce asked Mr. Martin if this was zoned C-3, would he modify his <br />buildings there? Commissioner Pearce also inquired if Mr. Martin could ask for <br />a conditional use permit when the property is zoned 1-2. Zack Johnson indicated <br />to Commissioner Pearce that Mr. Martin could not ask for a conditional use permit. <br /> <br />Discussion followed regarding the sewer and water for the property. <br /> <br />MOTION BY COMMISSIONER GUNKEL TO RECO}WffiND TO THE CITY COUNCIL DENIAL OF THE <br />
