229446v1 <br />or property owner is responsible for contacting the City when all the landscaping has been installed to set up an <br />inspection. <br />22. WETLAND MITIGATION. If the Developer proposes the filling of wetlands in connection <br />with development of the Subdivision said wetlands shall not be filled prior to receipt of necessary permits from <br />appropriate regulatory agencies to fill wetlands as proposed by the Developer and approval by the Technical <br />Evaluation Panel of the proposed mitigation plan for wetlands filling. If these permits are denied, or approval <br />of the wetland permit and mitigation plan is subject to conditions which significantly impact the Subdivision, the <br />final plat for the Subdivision shall be replatted and resubmitted to the City Council for consideration of changes <br />required for the wetland approvals. The City shall receive a copy of the monitoring report annually for three <br />years. <br />23. SPECIAL PROVISIONS. The following special provisions shall apply to plat development: <br />A. Compliance with City Resolution No. _____ granting final plat approval and the conditions stated <br />therein. <br />B. Ater all public improvements have been constructed and accepted by the City, the Developer shall <br />convey Outlots A, D, J, and F to the City by warranty deed, free and clear of any and all encumbrances. <br />C. The Developer shall install a temporary turnaround on the south end of Edison Street until it is <br />extended to the south with a future phase of the BRADFORD PARK development. The temporary <br />turnaround must be paved within one year of construction unless the roadway is extended. Before the <br />City signs the final plat, the Developer shall furnish the City an appropriately executed public temporary <br />turnaround easement, in recordable form. <br />D. Prior to City Council releasing the final plat, the Developer shall furnish a boundary survey of the <br />proposed property to be platted with all property corner monumentation in place and marked with lath <br />and a flag. Any encroachments on or adjacent to the property shall be noted on the survey. The <br />Developer shall post a $11,300 security for the final placement of interior subdivision iron monuments <br />at property corners. The security was calculated as follows: 113 lots at $100.00 per lot. The security <br />Page 73 of 299
