Rolling Hills Pond Dredging <br />Ell< River, Minnesota <br />12. If applicable, DNR dewatering/appropriations permit, and NPDES construction stormwater <br />permit will be secured by the City of Elk River for the project and inspections will be the <br />responsibility of the contractor. Conditions of the newest NPDES General Permit must be <br />followed. <br />S-6 Codes and Standards <br />Reference to codes and standards established by federal, state, and local agencies, or <br />the professional and trade societies and associations shall be to the latest edition at the time of contract <br />award. When conflicting information is given, the most restrictive shall apply. Any questions of intent <br />will be determined by the Engineer upon written request by the Contractor. <br />S-7 "Or Equal" Cause <br />Whenever a required material or article is shown on the Plans or in the Specifications <br />by using the name of a product or of a particular manufacturer, it is to be understood that other <br />products or materials which will adequately perform the required function may be considered equal <br />and satisfactory in the Engineer's opinion. A comparable product shall not be purchased or installed <br />without the Engineer's approval. A "Contract Change Order" shall be used if the Contract is to be <br />modified. <br />S-8 Additional Costs Incurred <br />If the Contractor feels that additional compensation should be paid due to an event <br />or condition that was unknown or unforeseen at the time the contract was awarded, the Contractor <br />shall notify the Engineer in writing of the event or conditions prior to taking any action. Any <br />additional compensation must be agreed upon by all parties involved including, but not limited to, the <br />Contractor, City, and Engineer. Any additional compensation made shall be made through the use of <br />a change order <br />S-9 Public Safety <br />The Contractor shall take the necessary precautions to protect the public and <br />employees from injury by hazardous circumstances by providing barricades, warning signs, flashers, <br />and other safety aids. The costs associated with all such items shall be considered incidental to the <br />project. <br />S-10 Project Storage Area <br />The City will provide material storage at the City Garage, 19000 Proctor Road. The <br />Contractor may choose to locate his own storage area and acquire permission from the appropriate <br />parties to store equipment and materials. The Contractor shall be responsible for restoring the storage <br />area back to its original condition. <br />Division S S-4 <br />
