Rolling Hills Pond Dredging <br />Ell< River, Minnesota <br />Other Terms and Conditions <br />1. All excavated pond material shall become the property of the contractor. <br />2. Quantities identified in the bid schedule are estimates. City representatives will work with <br />contractor to approve final excavation depths. Final payment will be based on actual <br />material removed. <br />Contractor is responsible for all basin and excavated material dewatering, if needed. Material <br />shall be sufficiently dewatered prior to hauling to avoid leaking from the haul trucks onto <br />public streets. All leaked or tracked material along any haul route shall be immediately <br />cleaned up by the contractor. <br />4. All work shall comply with applicable State and Federal regulations and requirements. The <br />contractor shall be responsible for compliance with all project permit conditions including, <br />but not limited to, meeting all environmental standards. <br />5. All work shall be completed without damage to the adjacent property, roadway surfaces, or <br />trail surfaces. Any disturbed turf or improved surface shall be restored to the acceptability <br />of the City Engineer and may require, up to, full depth, full width, repaving of the traffic <br />lane through the damaged area. <br />All disturbed turf areas shall be restored with vegetation to pre-existing conditions. All costs <br />required to re-establish vegetation shall be include in the bid. Temporary restoration shall <br />include a hydro mulch or erosion control blanket to all exposed soil areas unless noted <br />otherwise. Minimum measures for final restoration shall include the furnishing and <br />installation of 4" of topsoil, appropriate seed mixture, fertilizer and erosion control blanket <br />unless noted otherwise. Maintenance including but not limited to watering, erosion repair, <br />and re -seeding shall be required until the area has reached 70% vegetative cover. <br />7. The City will retain 5% of payments until final acceptance of the project. <br />8. Contractor must provide evidence of being bonded, licensed and insured. <br />9. The City Council reserves the right to reject any or all bids or any alternates or to hold bids <br />for forty-five (45) days; or accept any bid which, in the opinion of the City Council, serves <br />the best interest of the City; and to waive any minor irregularities. <br />10. All excavation and temporary seeding and mulching work must be completed on or by <br />February 16, 2024. Final turf restoration shall be completed by May 17, 2024, if necessary, <br />as determined by the assigned city representative. <br />11. The successful bidder will be required to enter the attached contract should the City Council <br />approve their bid. <br />Division S S-3 <br />
