The Contractor must comply with the following requirements. <br />1. The Contractor will not: <br />a. Offer any part of an Ash tree (Fraxinus spp.) from a quarantined area to any <br />industry or individual without an Emerald Ash Borer Compliance Agreement with <br />MDA; or <br />b. Make available any part of an ash tree or any non-coniferous (hardwood) species <br />with bark from the quarantined area for use as firewood; or <br />c. Transport any part of an ash trees, in any form, outside of a quarantined county <br />without complying with an Emerald Ash Borer Compliance Agreement with MDA; <br />or <br />d. Transport any part of ash trees, in any form, outside the state of MN without <br />contacting Jonathan.Osthus@state.mn.us to obtain the United States Department <br />of Agriculture's and the MDA's joint approval of the Emerald Ash Borer Compliance <br />Agreement. <br />2. The Contractor will: <br />a. Dispose of ash trees according to the Emerald Ash Borer Compliance Agreement; <br />and <br />b. Use the ash wood chips within the construction limits for erosion control, <br />construction exit pads, or other project related needs; and <br />The Owner will not directly compensate the Contractor for compliance with these <br />requirements. <br />ARTICLE 4 — MISCELLANIOUS <br />4.01 Prevailing Wage Clause <br />A. Pursuant to Minnesota Statutes 177.41 to 177.44, and corresponding Minnesota Rules <br />5200.1000 to 5200.1120, this contract is subject to the prevailing wages as established by <br />the Minnesota Department of Labor and Industry. Specifically, all contractors and <br />subcontractors must pay all laborers and mechanics the established prevailing wages for <br />work performed under the contract. Failure to comply with the aforementioned may result <br />in civil or criminal penalties. <br />4.02 Audit Clause <br />A. Pursuant to Minn. Stat. section 16C05 subd. 5, the Contractor will: <br />1. Maintain records which reflect all revenues, costs incurred and services provided in the <br />performance of this Agreement. <br />2. Agree that the County, the State Auditor, or legislative authority, or any of their duly <br />authorize representative at any time during normal business hours, and as often as they <br />may deem reasonable necessary, shall have access to and the right to examine, audit, <br />excerpt, and transcribe any books, documents, papers, records, etc., and accounting <br />procedures and practices and involve transactions relating to this agreement.
