Project Manual Houlton Conservation Area Bank Stabilization — Dam Site <br />Contractor agrees to maintain these records for a period of six (6) years from the date <br />of the termination of this agreement. <br />4.03 Equal Employment Opportunity Compliance <br />A. The City of Elk River (City) and Sherburne SWCD District (District) is an Equal Opportunity and <br />Affirmative Action employer. The Contractor with the City and District is required to follow <br />and conform to applicable federal, state, and City laws as they apply to the Contractor's duty <br />for Equal Opportunity and Affirmative Action employment. It is the Contractor's <br />responsibility to insure compliance with Equal Opportunity and Affirmative Action <br />requirements. Failure to comply with applicable Equal Opportunity and Affirmative Action <br />employment requirements may lead to Contractor sanctions. <br />4.04 Non-Discrimination Clauses <br />A. The Contractor agrees that: <br />1. In the hiring of common or skilled labor for the performance of any work under any <br />contract, or any subcontract, no contractor, material supplier, or vendor, shall, by <br />reason of race, creed, or color, discriminate against the person or persons who are <br />citizens of the United States or resident aliens who are qualified and available to <br />perform the work to which the employment relates; <br />2. No contractor, material supplier, or vendor, shall, in any manner, discriminate against, <br />or intimidate, or prevent the employment of any person or persons identified in clause <br />(A) of this section, or on being hired, prevent, or conspire to prevent, the person or <br />persons from the performance of work under any contract on account of race, creed, or <br />color; <br />3. A violation of this section is a misdemeanor; and <br />4. This contract may be canceled or terminated by the state, county, city, town, school <br />board, or any other person authorized to grant the contracts for employment, and all <br />money due, or to become due under the contract, may be forfeited for a second or any <br />subsequent violation of the terms or conditions of this contract. <br />4.05 Drug and Alcohol Testing Requirements <br />A. Contractors agree to comply with the drug and alcohol testing of the Code of Federal <br />Regulations, Chapter 49, incorporated therein. The Contractor shall immediately inform the <br />Owner when the testing and documentation requirements imposed by the Statute and <br />Regulations are not being met. Failure to abide strictly by this provision shall be considered <br />a major breech of the contracted services for this project. Contractor is to maintain driver's <br />files. All audits of this information shall be made available to the Owner upon request. <br />B. Moreover, if any independent truck operators are utilized by the Contractor for this project, <br />it shall be the responsibility of the Contractor to insure compliance of these provisions. <br />4.06 Possession of Firearms on Project Premises <br />A. Unless specifically required by the terms of this contract, no provider of services pursuant to <br />this contract, including but not limited to employees, agents or subcontractors of the Vendor <br />or Contractor shall carry or possess a firearm on Owner premises pursuant to the terms of <br />this agreement.
