c. Adequate off -site stacking for access and egress without impacting U.S. Highway 169. <br />12. The Aggregate Commercial 6th Addition plat (Case File P 22-05) shall be recorded. <br />13. Noise generated on the property via the Conditional Use Permit shall comply with those outlined <br />in the MPCA Guide to Noise Control. <br />14. The changeable copy sign shall not exceed 70 square feet and must comply with the standards set <br />forth in Sec. 30-864 (e). A sign permit is required. <br />15. A Minnesota Department of Natural Resources (DNR) Appropriation Permit shall be required <br />for any water use that is above 10,000 gallons a day or totaling 1 million gallons or more within a <br />year. This includes snow -making applications and spraying for dust control and other <br />construction needs. <br />16. Conditional Use Permit (CU 18-10) will become void upon the recording of this permit. <br />Background/Discussion <br />The subject property is east of Highway 169 between the 213`l' and <br />221 s' Avenue alignments. <br />The property is zoned Extreme Commercial Recreation (XCR) <br />where Off -Road Racing Facilities require a Conditional Use Permit. <br />The applicant requests an amendment to the previously approved <br />CUP to permit expansion of their large track, construct two roofed <br />viewing structures, and install a changeable copy sign (approximately <br />70 sq. ft.). <br />Overall, the current functions/activities on site will continue as they <br />have, but with the addition of a few additional structures and a track <br />expansion. The conditions from the 2018 CUP have been <br />incorporated into this amendment. <br />To complete the track expansion, ERX has applied for a Platted <br />Exemption to plat a portion of the property to include the expanded <br />track. This application will be reviewed by the City Council. <br />Transportation/ Circulation <br />The site has three access points to and from Highway 169. The <br />submitted site plan shows two access points to be used for <br />spectators and one for participants/riders. A third future access is shown directly across from 213"' <br />Avenue. <br />By the end of 2024, the 169 Redefine project will be complete and the conversion of US Highway 169 to <br />a freeway will greatly affect traffic patterns, primarily overserved with a lack of openings in traffic and <br />providing minimal opportunities to safely enter/cross US Highway 169. Staff has spoken with the <br />applicant regarding a future access at Brook Road and they understand the long-term vision for the <br />connection that would then provide access to the interchange at CR 33 and Highway 169. The applicant <br />is in ownership of the necessary properties to establish a connection to Brook Road. <br />
