Changeable Copy Sign <br />Section 30-880 states the subject parcel is allowed one freestanding sign, not to exceed 150 square feet <br />with a maximum height of 30 feet. One freestanding sign may be permitted for every 1,000 feet of street <br />frontage measured along a single street. Additional sign(s) shall be subject to the size and height <br />limitations of the first allowed freestanding or monument sign and may be placed no closer than 500 feet <br />to any other freestanding or monument sign. The applicant is proposing a 30-foot-tall sign with <br />approximately 70 sq. ft. of changeable copy. They are exploring two overall square footages. The <br />Planning Commission review is only for the changeable copy and the overall sign will require a building <br />permit. <br />With the standards set forth in Sec. 30-864 (e), the use should not endanger, injure or detrimentally affect <br />the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, <br />comfort, convenience or general welfare of the neighborhood or the city. <br />Applicable Regulation <br />In approving a Conditional Use Permit, the council may impose such specific conditions with regard to <br />the development or operation of the proposed use as it considers necessary to satisfy the seven standards <br />set forth in section 30-654 and the requirements contained in this article and to promote compatibility <br />with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />Weill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or <br />the public health, safety, morals, comfort, convenience orgeneral n elfare of the neighborhood or the city. <br />The property has been operating as an off -road racing facility for several years and as the main <br />uses on the campus are racing in nature, varying levels of noise are expected. By far, the most <br />common complaint the city receives about ERX is noise, with traffic being second. To help the <br />general welfare of the area, hours of operation need to be in place. Staff recommends the current <br />hours of operation continue as follows: <br />a. Sunday through Wednesday 7:00 a.m. — 9:00 p.m. <br />b. Thursday 7:00 a.m. — 10:00 p.m. <br />C. Friday and Saturday 7:00 a.m. — 11:00 p.m. <br />d. Five (5) three (3) day events per year, by special event permit, will be granted for <br />extended hours to midnight. <br />The applicant is requesting the hours operation on Friday and Saturday be extended by one hour <br />from 7:00 a.m. — 12:00 a.m. <br />2. Wlill be consistent with the Comprehensive Plan. <br />The property has a land use designation of Highway Business. The Highway Business category <br />primarily consists of a mix of auto -oriented retail and service businesses, restaurants, and <br />community and regional scale shopping centers. Highway Business uses are located along Highway <br />169 and Highway 10 and have high visibility from these corridors. <br />
