He further stated that he was concerned that such a small group of <br />people (the City Council) has the authority to make important decisions <br />for such a large number of people. <br /> <br />Chairman Wilson stated that it is the City government's pos~t~on to look <br />out for its citizens. He further stated that this ordinance will give <br />the city more control than they presently have. Mr. Wilson noted that <br />the UPA burn facility will be required to obtain a license per the new <br />ordinance requirements once the ordinance has been finalized, adopted and <br />published. and that the City will have the authority to look at the <br />operation in the future to place controls as necessary. <br /> <br />Mrs. Marilyn Schroeder of 13575 Island View Drive expressed her concern <br />that since the City is included in Clause 127. the operation can not be <br />required to put scrubbers. She also expressed her concern that even if <br />the City does have the authority to adopt this ordinance. Anoka County <br />can appeal the City controls to the Waste Management Board and the City <br />could be overruled. <br /> <br />Mrs.Mari1yn Hentges questioned when the new ordinance would take effect. <br />if inac ted. <br /> <br />Mr. Beck stated that <br />published, but that it <br />in place. <br /> <br />the ordinance will <br />will take some months <br /> <br />be in effect once it is <br />to get the license process <br /> <br />Chairman Wilson questioned Mr. Beck and Mr. Rohlf whether it would be <br />appropriate to recommend approval of the ordinance in concept and send it <br />on for the City Council to review the revised draft. or if the ordinance <br />amendment should remain under the Planning Commission's consideration <br />until they have worked out a more final document. <br /> <br />Mr. Rohlf stated that he felt the intent of the ordinance is contained in <br />this draft and that if the Planning Commission agrees with the intent of <br />the ordinance. it could be approved in concept, if not, it could be <br />denied. Mr. Beck stated that the Planning Commission also could table it <br />for further consideration. <br /> <br />Members of the Planning Commission expressed their agreement that this <br />item should be tabled and to continue the public hearing. <br /> <br />COMMISSIONER KROPUENSKE MOVED TO CONTINUE THE SOLID WASTE ORDINANCE <br />PUBLIC HEARING TO NOVEMBER 12, 1986 AT 7: 00 PM AT THE ELK RIVER SENIOR <br />HIGH SCHOOL COMMONS AREA. COMMISSIONER FUCHS SECONDED THE MOTION. THE <br />MOTION PASSED 6-0. <br /> <br />Chairman Wilson introduced Mr. Peter Kimball as the new Planning <br />Commission member. <br />
