<br />. <br /> <br />. <br /> <br />. <br /> <br />PAGE 3 <br /> <br />Planning Commission Minutes <br />October 28, 1986 <br /> <br />Mr. Bizano stated that he felt the two year license was too restrictive <br />and felt that the short term would make it difficult to sell bonds for a <br />20 to 30 million dollar issue. Mr. Bizano also stated that he felt some <br />of the language was appropriate for an incinerator but not appropriate <br />for an electric generating facility. <br /> <br />Mr. Beck stated that an annual review for these types of operation is not <br />unusual. and that the City ordinance specifies a two year review for <br />conditional use permits. He further stated that it is not the City's <br />intent to put an entire operation in danger of shutdown on a <br />technicality, but places the two year limitation to see that the <br />conditions set forth in the original permit are met. <br /> <br />Mr. Jerry Schroader of 13575 Island View Drive, Elk River, expressed his <br />support for the ordinance amendment stating that it was a real plus to <br />help protect the health and safety of the City and surrounding community. <br /> <br />Mr. Chris Kreger, Vice President of Elk River Landfill, Inc. stated that <br />he felt it was unneccessary for City to require further licensing and <br />permits, as he already must get a permit from the MPCA and from Sherburne <br />County. He stated that they do the same work and he is continually <br />touring inspectors through his operation as it is. Mr. Kreger stated <br />that he originally was not part of the City and did not choose to be, but <br />became a part of it due to the annexation. He stated that he tries to do <br />the best job possible operating the site and that they are trying to be <br />the best landfill in the State. Mr. Kreger further stated that he felt <br />it was unfair to propose that a minor violation could cause them to be <br />charged with a misdemeanor. Mr. Kreger concluded that they are all <br />trying to solve a major waste problem in the State and that he would like <br />to work with the City anyway he can, but felt that he should have been <br />asked for comments before the ordinance was drafted. <br /> <br />Mr. Mike Boelter, owner of Boelter's 76 Station, and a member of <br />Minnesota Towing Association, expressed his concern that many refuse <br />trucks are not properly plaquerd to show what they are carrying. He <br />stated that in case of an accident, it is important to know what is in a <br />particular vehicle for safety sake, to prevent contamination to a <br />person's skin, the environment, etc. <br /> <br />Mr. Dick Hetland, 18810 Boston Street, stated that he was interested in <br />how a requirement for scrubbers would be addressed in the proposed <br />ordinance. <br /> <br />Chairman Wilson stated that page thirty-seven of the ordinance provides <br />that the City. in its sole discretion, may require the best available <br />control technology for a particular type of operation, and could include <br />pollution control devices such as scrubbers or electro-static <br />precipitators. <br />
