<br />. <br /> <br />. <br /> <br />. <br /> <br />Page 2 <br /> <br />Planning Commission Minutes <br />October 28. 1986 <br /> <br />Mr. Beck stated that the formulation of a solid waste ordinance has been <br />discussed over the past several years. He stated that originally the <br />idea for this ordinance came about because of concerns with the increase <br />in the volume of solid waste going into the landfill, and codispals of <br />semi-dangerous materials to the landfill. Mr. Beck further stated that <br />the new ordinance would regulate and identify four types of waste <br />facilities that would be allowed in the City (1) sanitary Landfill (2) <br />solid waste processing facilities (3) transfer stations (4) waste burning <br />facilities. Mr. Beck stated that these types of facilities would be <br />allowed under the new ordinance providing they had the proper zoning, a <br />conditional use permit and a license. <br /> <br />Mr. Beck then gave a summary of the draft ordinance, noting additions and <br />corrections proposed. A copy of this draft ordinance is attached to and <br />part of these official minutes. <br /> <br />Commissioner Temple questioned if the ordinance was modeled after another <br />community ordinance or if it was unique to Elk River. Mr. Beck stated <br />that the ordinance, of other counties and cities were reviewed, and that <br />this ordinance is as or more comprehensive than others, and further, that <br />it address the specific needs of Elk River. <br /> <br />Mr. Beck suggested that <br />ordinance should contact <br />the following Monday. <br /> <br />anyone who wanted a copy of the revised draft <br />city staff, and that it would be available by <br /> <br />Commissioner Fuchs questioned how the criteria for waste burning <br />facilities and/or incinerators was established. Mr. Rohlf stated that <br />the revised ordinance would cover incinerators burning 2,000 lbs. per <br />hour or more. Mr. Beck stated that they may leave the requirement at <br />6,000 lbs. per hour so that small incineration operations such as those <br />at the school and grocery stores would not be included, but that the <br />city's consultant felt they could still use the 2,000 lbs. per hour and <br />not affect those types of uses. <br /> <br />Chairman Wilson opened the public hearing. <br /> <br />Mr. Joe Bizano, of Long Lake. Minnesota, attorney representing NSP. <br />stated that the proposed ordinance would affect engineering and <br />management considerations and that more time was needed to review the <br />proposed ordinance. He also asked that if the ordinance is to be <br />redrafted, when they would have an opportunity to express their comments. <br />Mr. Beck stated that if the Planning Commission chose to continue the <br />public hearing. NSP could present their comments at that time, or if they <br />chose to approve the ordinance draft in concept and sent it on to the <br />City Council, a public hearing would be held for public input. <br />
