<br />Page 5 <br /> <br />Planning Commission Minutes <br />.ptember 23. 1986 <br /> <br />-------------------------- <br /> <br />Ms. Debbie Johnson questioned whether or not the entire 153rd easement <br />would be built up. Mr. Rohlf stated that the road would be built up just <br />before it enters the property in question. <br /> <br />Mr. Gerry Smith reviewed the past history of the property; stating that he <br />was told by both the County and City that the lot was buildable. <br /> <br />Mr. Rohlf stated that the first floor of the house must be one foot above <br />the 100 year flood level and that the road can be no more than one foot <br />below that mark unless a variance is granted by the City. Mr. Rohlf <br />recommended that the road access be built up to 856 feet at the end of the <br />street easement. <br /> <br />Discussion was carried on regarding the berm on the riverbank side of the <br />property and its value for flood control. <br /> <br />Chairman Wilson closed the public hearing. <br /> <br />Discussion was carried on whether it would be best to get the road up to <br />City standards for acceptance or leave it as a private road with a private <br />road agreement. <br /> <br />. <br /> <br />Commissioner Barrett questioned whether or not the City would accept the <br />road easement as a City street. Mr. Carson stated that they would have to <br />do the entire street to be accepted as a City street. <br /> <br />Mr. Rohlf stated that the City maintenance currently ends at Mr. Burke's <br />property for snow removal and grading. <br /> <br />Commissioner Fuchs stated that in order for Mr. Carson's access to meet up <br />with the current street he would need to extend his access approximately <br />25 feet from the end of his property line. <br /> <br />Mr. Rohlf stated that he recommended a private road agreement. Mr. Carson <br />stated that he was willing to enter into one. <br /> <br />Mr. Rohlf stated that the new DNR requirement for a minimum of a 20,000 <br />square foot lot did not apply to Mr. Carson's lot because it is an <br />existing lot, not a new lot. <br /> <br />COMMISSIONER FUCHS MOVED TO RECOMMEND THAT THE CITY COUNCIL APPROVE THE <br />FOLLOWING: <br /> <br />1. A REQUEST BY MR. RICHARD CARSON FOR A 25 FOOT ENCROACHMENT ON THE <br />100 FOOT SETBACK FROM THE ORDINARY HIGH WATER MARK, CONTINGENT <br />UPON THE DNR' S APPROVAL. <br /> <br />. <br /> <br />2. <br /> <br />THAT A PRIVATE ROAD AGREEMENT BE ENTERED INTO WITH MR. CARSON FOR <br />THE ROAD ACCESS TO HIS PROPERTY. <br />
