THE MOTION PASSED 6-0. <br /> <br />6. Variance Request by Chatteau Construction/P.H. <br /> <br />Mr. Richard Carson of 17551 Round Lake Boulevard, Anoka explained that he <br />has purchased a piece of property on the Mississippi River from Mr. Jerry <br />Smith of White Dove Realty, and that in order to construct a house, he <br />needs the approval of the Planning Commission and City Council for the <br />following items: <br /> <br />(1) <br /> <br />A private road agreement for access to his property from the 153rd <br />Avenue easement. <br /> <br />. <br /> <br />(2) <br /> <br />A variance on the required elevation of the private road. <br /> <br />(3) A variance for a 25 foot encroachment on the 100 foot setback <br />required from the ordinary highwater mark from the Mississippi <br />River. <br /> <br />Mr. Carson stated that in order to meet the requirement of the Flood plain <br />ordinance it would be necessary to raise 153rd at the point where it <br />connects with his property. Mr. Carson further stated that the lot was <br />not large enough to permit him to meet the required 100 foot setback. <br /> <br />Mr. Rohlf stated that he recommended approval of the 25 foot encroachment, <br />contingent upon approval by the DNR when they have had more time to review <br />the proposal. Mr. Rohlf further stated that he recommended that a private <br />road agreement be entered into, whereas the property owner would be <br />responsible for maintenance of the road. He explained that the reason for <br />the designation of the road evaluation is to help insure that emergency <br />vehicles could access the property in flood conditions. Mr. Rohlf further <br />explained that to raise the road to such a height would be unreasonable <br />and would cause problems for neighbors whose access is also lower than the <br />required elevation and suggested that a slightly lower elevation be <br />allowed so that Mr. Carson's property access would match up with the 153rd <br />road easement and be built up toward the location of the home site. <br /> <br />. <br /> <br />Chairman Wilson opened the public hearing. <br />
