<br />Page 8 <br /> <br />Planning Commission Minutes <br />August 25. 1987 <br /> <br />. <br /> <br />The Building and Zoning Administrator reviewed the site plan for the <br />proposed garage with the Planning Commission and indicated he felt Mr. <br />Gutzwiller met the five standards for granting a variance due to the <br />following reasons: <br /> <br />-If the 30 foot setback were adhered to. the garage would be on top of <br />the existing drainfield. <br /> <br />-The western portion of the lot is drainage easement. <br /> <br />-If the garage were to be placed further north on the property to avoid <br />the drainfield. the garage would encroach on the side yard setback. <br /> <br />COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE VARIANCE REQUEST BY MR. GUTZWILLER ON PROPlRTY DESCRIBED AS LOT 12. <br />BLOCK 5. BRENTWOOD ADDITION. FOR A 15 FOOT ENCROACHMENT ON THE 35 FOOT <br />FRONT YARD SETBACK TO ACCOMMODATE A DETACHED GARAGE FOR THE ABOVE LI ST!D <br />REASONS. COMMISSIONER TEMPLE SECONDED THE MOTION. THE MOTION CARRIED 6- <br />O. <br /> <br />11. Conditional Use Permit/D.J.'s Truck Sales/Public Hearing <br /> <br />Chairman Wilson opened the public hearing. There being no one for or <br />against the the matter. Chairman Wilson closed the public hearing. <br /> <br />~ COMMISSIONER FUCHS MOVED TO RECOMMEND TO THE CITY COUNCIL THAT THE <br />CONDITIONAL USE PERMIT REQUESTED BY D. J. 's TRUCK SALES BE TABLED UNTIL <br />SUCH TIME THAT THE APPLICANT REAPPLY FOR A CONDITONAL USE PERMIT. DUE TO <br />THE FACT THAT THE APPLICANT WAS NOT PRESENT DURING THE LAST TWO PLANNING <br />COMMISSION MEETINGS. COMMISSIONER MORTON SECONDED THE MOTION. THE <br />MOTION CARRIED 6-0. <br /> <br />Preliminary Plat Review (Proposed Holt Addition) by Elk River True <br />Value Home Center/Public Hearing <br /> <br />Chairman Wilson explained that True Value Home Center is requesting a <br />replat of Lots 1.2, and 3 of Block 13. Old Village of Elk River Addition <br />to make one lot out of three. <br /> <br />Chairman Wilson opened the public hearing. There being no one for or <br />against the matter. Chairman Wilson closed the public hearing. <br /> <br />COMMISSIONER MORTON MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE PRELIMINARY PLAT REQUESTED BY TRUE VALUE HOME CENTER TO COMBINE <br />LOTS 1. 2. lie 3. BLOCK 13. OLD VILLAGE OF ELK RIVER ADDITION INTO ONE LOT <br />CALLED HOLT ADDITION. COMMISSIONER KIMBALL SECONDED THE MOTION. THE <br />MOTION CARRIED 6-0. <br /> <br />13. <br /> <br />Conditional Use Permit/Elk River True Value/Public Hearing <br /> <br />"Mi;t <br /> <br />~ <br /> <br />Chairman Wilson stated that Elk River True Value Home Center is <br />requesting a conditional use permit to allow a lumber yard in a C-4 <br />zone. He noted the proposed lumber sales will consist of a storage <br />building of 100' by 150' in size. Chairman Wilson stated that the <br />building will be located on the previously replated and combined lots of <br />1.2. and 3. Block 13, Old Village of Elk River Addition. <br />
