THAT THERE BE NO SIGNAGE ON THE OUTSIDE OF THE HOUSE. <br /> <br />COMMISSIONER BARRETT SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />9. Conditional Use Permit/Patrick Cherney/Public Hearing <br /> <br />Chairman Wilson introduced the conditional use permit request by Mr. <br />Cherney and explained that Mr. Cherney is requesting a permit to operate <br />light manufacturing and related sales in a C-3B district. He indicated <br />that Mr. Cherney refurnishes furniture and restores antiques. <br /> <br />The Building and Zoning Administrator indicated that Mr. Cherney is <br />currently operating out of the site in question because he was <br />misinformed about the need for a conditional use permit. The Building <br />and Zoning Administrator further stated that he had inspected the <br />building and found it to meet all the proper codes for his <br />business. <br /> <br />. <br /> <br />Commissioner Temple questioned the septic system and the possible toxic <br />and dangerous chemicals used in refinishing furniture in relation to <br />disposing of these chemicals. Mr. Cherney stated he has been in contact <br />with the MPCA and assured the Planning Commission these chemicals are <br />being handled appropriately. <br /> <br />Commissioner Wilson opened the public hearing. There being no one for <br />or against the matter, Chairman Wilson closed the public hearing. <br /> <br />COMMISSIONER BARRETT RECOMMENDED TO THE CITY COUNCIL APPROVAL OF THE <br />CONDITIONAL USE PERMIT REQUESTED BY PATRICK CHERNEY FOR PROPERTY LEGALLY <br />DESCRIBED AS LOT 3, BLOCK 1, AVON ACRES 4TH ADDITION, WITH THE FOLLOWING <br />STIPULATIONS: <br /> <br />1. THAT HE DOES NOT EXCEED 260 SQUARE FEET OF EXISTING OR ADDED ON <br />SIGNAGE. <br /> <br />2. THAT THE PARKING LOT CONSIST OF SEVEN PARKING STALLS, STRIPED AND <br />HARD-SURFACED. INCLUDING ONE HANDICAP STALL. <br /> <br />3. THAT THE DRIVES AND THE LOADING AREA BE HARD-SURFACED. <br /> <br />4. THAT THE DRAINAGE REMAIN AS EXISTING UNLESS OTHERWISE APPROVED BY <br />CITY STAFF. <br /> <br />5. THAT THE AREA NOT HARD-SURFACED BE MAINTAINED AS IS, WITH EXISTING <br />NATURAL GRASS. <br /> <br />COMMISSIONER TEMPLE SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />. 10. <br /> <br />Variance Request by Raymond Gutzwiller/Public Hearing <br /> <br />Chairman Wilson indicated the Mr. Gutzwiller is requesting a variance <br />for property located on Lot 12, Block 5, Brentwood Addition, for a 15 <br />foot encroachment on the 35 foot front yard setback required to <br />accommodate a detached garage. <br />
