<br />. <br /> <br />. <br /> <br />. <br /> <br />Page 8 <br /> <br />Planning Commission Minutes <br />April 28. 1987 <br /> <br />COMMISSIONER KROPUENSKE MOVED TO RECOMMEND TO THE CITY COUNCIL. APPROVAL <br />or THE VARIANCE REQUEST BY SHERBURNE COUNTY FOR A 7 FOOT ENCROACHMENT ON <br />THE MAXIMUM HEIGHT ALLOWANCE FOR THE ADDITION TO THE COURT HOUSE. <br />COMMISSIONER BARRETT SECONDED THE MOTION. THE MOTION PASSED 7-0. <br /> <br />15. Variance Request by Dick Carson/Public Hearing <br /> <br />Chairman Wilson indicated that Mr. Carson is requesting a 43 foot <br />encroachment on the 50 foot front yard setback; a 33 foot encroachment on <br />the 50 foot rear setback; and a 3 foot encorachment on the 25 foot <br />side yard setback in order to build a house. <br /> <br />Mr. Carson stated when he purchased the property and drew his plans for <br />his house. he was under the impression that the property was zoned <br />residential when. in fact. it is agricultural. <br /> <br />Mr. Rohlf. Building and Zoning Administrator. indicated that this is a <br />legal lot of record and the setback virtually makes the lot unbuildable. <br /> <br />Discussion was held at this time regarding the placement of the septic <br />system. <br /> <br />Chairman Wilson opened the public hearing. <br /> <br />Mr. Art Johnson stated he owns the property one lot away and stated his <br />concern regarding the size of the variance which is dictated by the size <br />of Carson's house. He further indicated his concern regarding the sewer <br />system. <br /> <br />Chairman Wilson closed the public hearing. <br /> <br />COMMISSIONER KROPUENSKE MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL <br />OF THE VARIANCES REQUESTED BY MR. CARSON FOR THE FRONT. REAR AND SIDE <br />YARD SETBACKS TO BUILD A HOME WITH THE STIPULATION THAT THE SEPTIC <br />LOCATION BE DETERMINED PRIOR TO THE COUNCIL MEETING. COMMISSIONER <br />BARRETT SECONDED THE MOTION. THE MOTION PASSED 7-0. <br /> <br />16. <br /> <br />Variance Request for the Plat of Fairhaven Hills <br /> <br />The Building and Zoning Administrator stated that the developers of the <br />Plat of Fairhaven Hills are requesting a variance to allow Lots 1. 2. and <br />3 of Block 3 to vary from the 2 1/2 acre minimum lot size requirements. <br />He noted this was not published as a public hearing at Planning <br />Commission level due to the time delay which would be caused. He <br />indicated that the City Council would consider the Planning Commission's <br />recommendation and that there would be a public hearing at the <br />Council. <br /> <br />The Planning Commission discussed the variance and concurred with the <br />following as reasons for granting the variance: <br />
