<br />. <br /> <br />. <br /> <br />. <br /> <br />Page 9 <br /> <br />Planning Commission Minutes <br />January 27, 1987 <br /> <br />Chairman <br />which is <br />Building <br /> <br />Wilson questioned what the lots were zoned on Ulysses Street <br />a platted area directly east of the Waletzko's property. The <br />and Zoning Administrator noted this property was zoned R-1a. <br /> <br />Chairman Wilson <br />Waletzko's being <br />variation in use <br />request. <br /> <br />stated that because of these lots across from the <br />less than an acre in size, and further that there is no <br />to the land, it would be unreasonable to deny the <br /> <br />Chairman Wilson opened the <br />against the variance request. <br /> <br />public hearing. No one appeared for or <br />Chairman Wilson closed the public hearing. <br /> <br />Commissioners Kimball and Morton questioned the fact of setting a <br />precedent by granting this lot size variance. <br /> <br />Discussion was held regarding possibly acquiring some extra land from a <br />neighbor in order to avoid the variance. <br /> <br />Chairman Wilson stated he felt that due to the fact the request is only <br />for a small percentage of the 2.5 acre requirement, he would be in favor <br />of the request. <br /> <br />Chairman Wilson reviewed the five standards necessary to grant a <br />variance. Commissioner Temple stated she felt the Woletzko's were in <br />compliance with all five standards and therefore, would be in favor of <br />granting a variance. <br /> <br />COMMISSIONER TEMPLE MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE .4 ACRE LOT SIZE VARIANCE REQUESTED BY DOUGLAS AND SHARON WALETZKO <br />NOT TO EXCEED 10% BY SPLITTING THE LAND IN HALF AND THAT THE PLANNING <br />COMMISSION BASE THEIR RECOMMENDATION FOR A VARIANCE ON THE ECONOMIC <br />SITUATION INVOLVED WITH THE LOT IN REGARDS TO ROADS, THE HISTORY OF THE <br />LAND AND ALSO THE RELATIONSHIP TO OTHER HOUSING IN THE AREA, AND FURTHER <br />THAT THE VARIANCE MEETS THE FIVE STANDARDS STIPULATED IN THE CITY <br />ORDINANCE. COMMISSIONER MORTON SECONDED THE MOTION. THE MOTION PASSED <br />4-1. COMMISSIONER KIMBALL VOTED AGAINST THE MOTION. <br /> <br />COMMISSIONER TEMPLE MOVED THAT THE PLANNING COMMISSION MEETING BE <br />EXTENDED PAST MIDNIGHT. COMMISSIONER KIMBALL SECONDED THE MOTION. THE <br />MOTION PASSED 4- 1. COMMISSIONER BARRETT OPPOSED. <br /> <br />12. Conditional Use Permit Request by Elk River United Methodist Church <br />Public Hearing <br /> <br />The Building and Zoning Administrator noted that the United Methodist <br />Church is requesting a conditonal use permit to expand the church parking <br />lot. Mr. Robert McCartney, representative of the United Methodist <br />Church, explained that they are requesting to enlarge the parking lot so <br />as to bring it into compliance, as close as possible, to the City Code. <br /> <br />Commissioner Wilson opened the public hearing. <br /> <br />.. <br />
