She indicated this may eliminate the sewer <br />hazards with surrounding wells. <br /> <br />Chairman Wilson closed the public hearing. <br /> <br />COMMISSIONER BARRETT MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE PRELIMINARY PLAT FOR OAK KNOLL WITH THE FOLLOWING STIPULATIONS: <br /> <br />1) THAT A 25 FOOT TEMPORARY EASEMENT BE INCLUDED ON COUNTY ROAD 35. <br /> <br />2) THAT LOTS 18 & 19 AND 20 & 21 HAVE SHARED DRIVEWAYS. <br />3) THAT THE IMPROVEMENT OF TROY STREET BE POSTPONED. <br />4) THAT AN URBAN SECTION VERSUS A RURAL SECTION ROAD BE USED. <br />5) THAT STAFF RESEARCH THE POSSIBILITY OF PARK LAND. <br /> <br />6) THAT THE "URBAN RUN OFF AND SOIL EROSION HANDBOOK" IS FOLLOWED <br />FOR CONTROLLING EROSION. <br /> <br />7) THAT THE RECOMMENDATIONS SUBMITTED BY WILLIAM HARJU IN HIS LETTER <br />DATED JANUARY 22. 1987 BE ADHERED TO. <br /> <br />COMMISSIONER TEMPLE SECONDED THE MOTION. THE MOTION PASSED 5-0. <br /> <br />9. Consider Variance Request by New Creations/Public Hearing <br /> <br />The Building and Zoning Administrator <br />is requesting a 15 foot encroachment <br />required in an A-1 zoned district <br />dwelling. He noted the variance is <br />Greenhead 3rd Addition. <br /> <br />explained that New Creation Homes <br />on the 50 foot front yard setback <br />to accommodate a single family <br />proposed for Lot 37. Block 1. <br /> <br />Darrell Peterson. representative of New Creation Homes explained that the <br />survey had been done by John Oliver and a mistake had been made in that <br />he used the Old City Ordinance as the setback. <br /> <br />The Building and Zoning Administrator noted that the setback error was <br />missed during the plan review by the City Building Inspector. Mr. Rohlf <br />stated that he felt that between the wrong survey and the topography <br />change towards the rear of the lot that his lot would meet the five <br />standards for a variance and; therefore. had allowed the builder to <br />continue with the house. <br />
