He asked at what point does a home occupation <br />switch from residential to commerical. Commissioner VanValkenburg felt <br />that some sort of time frame limit should be set. <br /> <br />Chairman Kimball requested that home occupations be added to the agenda <br />for discussion at the joint meeting of the City Council and Planning <br />Commission on September 13, 1990. <br /> <br />COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY APPROVAL OF THE <br />CONDITIONAL USE PERMIT REQUEST BY PAUL OUELLETTE (GEMINI <br />COMMUNICATIONS) SITING STAFF'S COMMENTS ON THE FIVE STANDARDS FOR A <br />HOME OCCUPATION AND SITING THE SEVEN STANDARDS FOR A CONDITIONAL USE <br />PERMIT. <br /> <br />Chairman Kimball stated that he would like to see the following <br />findings of fact added to the motion: the business is predominantly <br />staffed with family members with very few outside members; the business <br />does not generate any more traffic and noise than what is generated in <br />a normal residential neighborhood; that the business is run in an <br />extremely efficient manner and that the signage is kept to a minimal. <br /> <br />Commissioner Eberley was in disagreement with Chairman Kimball's <br />finding that family members should be supported as a finding of fact as <br />the seven standards for a conditional use permit do not address family <br />versus non-family, but rather they address resident versus non-resident <br />employees. Chairman Kimball felt that this finding was supported by <br />staff's memo. <br /> <br />COMMISSIONER EBERLEY CONTINUED HER MOTION TO RECOMMEND THAT THE <br />APPROVAL OF THE REQUEST INCLUDE THE FOLLOWING STIPULATIONS: <br /> <br />1. THE GARAGE SHALL MAINTAIN ONE PARKING STALL FOR THE SOLE USE OF A <br />VEHICLE. <br /> <br />2. THAT ALL MATERIALS AND EQUIPMENT ASSOCIATED TO THE BUSINESS BE <br />KEPT IN THE CONFINES OF THE HOUSE AND/OR GARAGE. <br /> <br />3. THAT THE APPLICANT IS PERMITTED ONE SIGN NOT TO EXCEED 2 SQ. FT. <br />IN AREA AND SHALL BE MOUNTED FLAT ON THE OUTSIDE WALL OF THE <br />BUILDING. <br /> <br />4. THAT THE HOURS OF OPERATION BE ALLOWED TO CONTINUE AT 24 HOURS A <br />DAY, BUT THAT THE NON-RESIDENTIAL EMPLOYEES BE RESTRICTED TO HOURS <br />THAT ARE BETWEEN 7:00 A.M. AND 8:00 P.M. <br /> <br />5. THAT ANY STRUCTURAL ALTERATIONS TO THE HOUSE OR. THE GARAGE TO <br />ACCOMMODATE THIS BUSINESS SHALL REQUIRE A BUILDING PERMIT. <br /> <br />6. THAT THE CONDITIONAL USE PERMIT SHALL BE VALID FOR ONE YEAR. AT <br />THAT TIME THE APPLICANT MUST RENEW HIS PERMIT. <br /> <br />COMMISSIONER SCHROEDER SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br />
