<br />Planning Commission Minutes <br />August 28, 1990 <br /> <br />Page 4 <br /> <br />. <br /> <br />Dave Harmonick - 21146 York Street NW (owner of Lot 8) questioned the <br />location of the driveway. Mr. Harmonick felt that the portion of the <br />driveway which encroaches on his property should be removed. Ms. <br />Szklarski stated that the driveway does encroach slightly on Mr. <br />Harmonick's property. She questioned if the City could require that <br />portion of the driveway to be removed. Mr. Harmonick further requested <br />that there be an additional stipulation that no permanent or temporary <br />structures be erected along the south side of the structure other than <br />landscaping. This would require the removal of two kennels that are on <br />the south side. <br /> <br />Tim Keane, City Attorney stated that it should be clearly stated that <br />this variance does not constitute the City's blessing of the driveway <br />encroachment on Lot 8. This would be a private matter between the two <br />lot owners which is not covered by this variance. <br /> <br />Ms. Sue Springer stated that the survey that was done for the new home <br />on the property shows that the driveway is encroaching .08 feet on Lot <br />8. They had confronted the builder and he did not think this would be <br />a problem. She further indicated that the two dog kennels on the south <br />side are being removed. <br /> <br />Chairman Kimball closed the public hearing. <br /> <br />. <br /> <br />COMMISSIONER SCHROEDER MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL <br />OF THE VARIANCE BY SPRINGER CONSTRUCTION TO ALLOW, AN 11 FT. <br />ENCROACHMENT ON THE 20 FT. SIDE YARD SETBACK TO ACCOMMODATE A HOUSE <br />SITING THE FIVE STANDARDS AS OUTLINED IN STAFF'S MEMO TO INCLUDE THE <br />STATEMENT GIVEN BY THE CITY ATTORNEY THAT THE CITY DOESN'T GIVE <br />APPROVAL AS FAR AS THE DRIVEWAY IS CONCERNED REGARDING THIS VARIANCE. <br />ALSO, THAT THE HOUSE ON LOT 7 SHOULD NOT HAVE PERMANENT OR TEMPORARY <br />STRUCTURES BUILT ON THE SOUTH SIDE OF THE LOT. COMMISSIONER BISCHOFF <br />SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />9. <br /> <br />Consider Conditional Use Permit (Home Occupation - Phone Answering <br />Service) by Gemini Communications/P.H. <br /> <br />Janelle Szklarski, Zoning Assistant, stated that Paul Ouellette of <br />19741 Ulysses Street NW is requesting a condi tional use permit to <br />operate a home occupation. The conditional use permit would allow the <br />applicant to operate a telephone answering service from his home. Ms. <br />Szklarski stated that Mr. Ouellette is currently operating the business <br />out of his garage. Ms. Szklarski stated one of the concerns staff has <br />with this proposal is the number of employees. In the past, it has been <br />the Planning Commission and City Council's tendency to allow few if any <br />outside employees. <br /> <br />Chairman Kimball opened the public hearing. <br /> <br />i. <br /> <br />Mr. Ouellette explained his request indicating that they have a total <br />of eight outside employees, four of which are family. He indicated two <br />of the family members live across the street and the other two live in <br />Anoka. Mr. Ouellette was requesting that the hours of operation be <br />expanded to better accommodate his business. <br />
