<br />Elk River Planning Commission <br />October 27, 1992 <br /> <br />Page <br /> <br />3 <br /> <br />. <br /> <br />official has inspected the site and is working with the property owner <br />regarding building codes. <br /> <br />Commissioner Minton asked why staff had recommended that the hours of <br />operation be different from that which the ordinance allowed. Ms. <br />Szklarski remarked that the ordinance spells out hours of operations <br />for permitted home occupations which typically do not involve customer <br />traffic. She feels the limited hours should be enforced due to <br />customer traffic. It was a consensus of the Planning Commission that <br />due to the proposed location of the business, traffic would not be a <br />major concern, therefore, the hours of operation outlined in the code <br />(7:00 a.m. to 10:00 p.m.) should be allowed with this use. <br /> <br />COMMISSIONER JOHNSON MOVED TO RECOMMEND APPROVAL OF THE CONDITIONAL USE <br />PERMIT REQUEST BY JULIE SCHULZE AND TERESA LAWSON CITING STAFF'S MEMO <br />AS WELL AS THE SEVEN STANDARDS FOR A CONDITIONAL USE PERMIT SUBJECT TO <br />THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT THE APPLICANT PROVIDE AT LEAST 3 PARKING STALLS. <br /> <br />2. THAT THE APPLICANT MEET ALL APPLICABLE BUILDING CODE CONCERNS. <br /> <br />3. THAT ONE NONRESIDENT EMPLOYEE, THE CO-APPLICANT, BE ALLOWED. <br /> <br />4. <br /> <br />THAT SIGNAGE FOR THE PROPOSED USE BE ON PREMISE. THAT <br />SIGNAGE ALSO ALLOW A WALL SIGN AS WELL AS A FREE STANDING SIGN <br />THE ENTRANCE OF THE SITE. THE WALL SIGNAGE SHOULD BE LIMITED <br />TWO SQUARE FEET AND THE FREE STANDING SIGN SHOULD BE LIMITED <br />TEN SQUARE FEET. <br /> <br />THIS <br />AT <br />TO <br />TO <br /> <br />. <br /> <br />5. THAT THIS USE BE REVIEWED ON AN ANNUAL BASIS BY STAFF AND THAT THE <br />PLANNING COMMISSION REVIEW THE REQUEST EVERY 3 YEARS TO DETERMINE <br />THE EFFECT ON THE SURROUNDING PROPERTIES. <br /> <br />COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 7-0. <br /> <br />Commissioner Minton indicated the need to review/amend the ordinance to <br />clarify the issue of retail home occupations being allowed as a <br />conditional use. <br /> <br />8. Consider a Variance Request on Maximum Length of a Dead-end Road by <br />David Gow/public Hearing <br /> <br />. <br /> <br />stephen Rohlf, Building and Zoning Administrator, stated that Mr. Gow <br />is requesting a 600 foot variance to the 500 foot maximum length for a <br />dead-end road. The request would allow an 1,100 foot dead-end road to <br />be constructed. Further, the applicant proposes to develop a 40 acre <br />parcel thus, a longer dead-end road was needed. Mr. Gow chose to apply <br />for a variance prior to platting the property to avoid costly platting <br />procedures that would be useless if the variance was not approved. Mr. <br />Rohlf reviewed this request with the City Attorney and staff is <br />recommending that this request be tabled until the plat and variance <br />requests are in front of the City Council so the two requests can be <br />considered together. <br />
