<br />Elk River Planning Commission <br />October 27, 1992 <br /> <br />Page <br /> <br />2 <br /> <br />. <br /> <br />6. <br /> <br />Consider Conditional Use Permit Request by Jeff Mastley/Public Hearing <br /> <br />Janelle Szklarski, Zoning Assistant, stated that the applicant is <br />requesting a Conditional Use Permit to excavate 6,200 cubic yards of <br />fill from a lowland grass area. Furthermore, as this area falls within <br />County Ditch 28 thus, County approval of this excavation is required in <br />addition to City approval. Ms. Szklarski noted that the County Board <br />will be discussing this issue at their November 18, 1992 meeting. <br />staff is recommending that this item be tabled until the November 24, <br />1992 Planning Commission meeting so that the County's concerns can be <br />addressed by the City. <br /> <br />Chairman Nadeau opened the public hearing. <br /> <br />COMMISSIONER SPOTTS MOVED TO CONTINUE THE PUBLIC HEARING ON THIS <br />REQUEST TO THE NOVEMBER 24, 1992 PLANNING COMMISSION MEETING IN ORDER <br />TO RECEIVE COMMENTS FROM THE COUNTY. COMMISSIONER EBERLEY SECONDED THE <br />MOTION. THE MOTION CARRIED 7-0. <br /> <br />7. Consider Conditional Use Permit Request by Julie Schulze and Teresa <br />Lawson/Public Hearing <br /> <br />. <br /> <br />Janelle Szklarski, Zoning Assistant, commented that the applicant's are <br />requesting a Conditional Use Permit to operate a retail craft sales <br />home occupation at 22822 Baldwin NW, Elk River. The request would <br />involve remodeling a chicken coop into a craft store and that this <br />remodeling would be subject to several building codes. Staff is <br />recommending that no off-premise signage be allowed for this request. <br />In addition, Ms. Szklarski felt the ordinance was unclear in regards to <br />retail uses as a home occupation and that if retail uses are allowed as <br />a home occupation, the Planning Commission needs to review the proposed <br />use with regard to population density. The proposed home occupation <br />would be fairly small and is in a relatively secluded area. Staff did <br />not have major concerns with traffic generated from this use and was <br />recommending approval with several stipulations. <br /> <br />Julie Schulze announced that she would like to have signage to <br />advertise her business along Highway 169. Ms. Szklarski responded that <br />although the Schulze's own property along Highway 169 it is a separate <br />parcel from that on which the use is located, therefore, it would be an <br />off-premise sign. The applicant could combine these two parcels to <br />eliminate the off-premise status. <br /> <br />Chairman Nadeau opened the public hearing. <br /> <br />Ernest Toth, 22191 Highway 169, commented that he is an adjoining <br />property owner has no objections to the proposed use. <br /> <br />. <br /> <br />There being no further comments from the public, Chairman Nadeau closed <br />the public hearing. <br /> <br />Commissioner Spotts expressed <br />issues not yet resolved.
