<br />. <br /> <br />given. The City Administrator is also responsible for the <br />maintenance and recommended revisions of the provisions of this <br />Ordinance and management of the City's overall personnel <br />program. <br /> <br />3. Duration of Employment. The duration of employment for <br />any employee is for an indefinite period of time. Except as <br />restricted by statute or applicable Collective Bargaining <br />Agreement, the City may dismiss an employee at any time for any <br />lawful reason with or without notice. Subject to Section <br />218.08, Subd. 7, an employee may terminate City employment at <br />any time. After an employee has successfully completed an <br />Orientation Period after hire or promotion, as indicated by a <br />satisfactory performance evaluation and as approved by the City <br />Administrator, she/he shall be designated a Regular Full-time <br />or Regular Part-time Employee. Such designation shall be used <br />to differentiate between employees completing an Orientation <br />Period and regular employees. The term "regular" shall not be <br />used to define duration of employment with the City. <br />Employment for all employees shall remain at-will and may be <br />terminated by either the City or the employee as described <br />above. <br /> <br />4. Applicability. All City employees shall be subject to <br />this Ordinance, except the following: <br /> <br />a. Elected Officials; <br /> <br />. <br /> <br />b. <br /> <br />Members of boards and commissions; <br /> <br />c. Volunteer firefighters and other volunteer personnel; <br /> <br />d. Consul tants rendering professional services on a fee <br />basis; and <br /> <br />e. Any other person specifically exempted by the City <br />Council. <br /> <br />The foregoing notwithstanding, the above-mentioned employees <br />shall remain subject to this Ordinance with regard to Section <br />218.08, Subd. 5, herein. <br /> <br />5. PreviouslY Accrued Sick Time and Vacation Time. All <br />City employees who had accrued sick time and vacation time <br />prior to the effective date of this Ordinance (July, 1990), <br />shall maintain all benefits previously accrued to them. All <br />employees shall be subject to the provisions of this Ordinance <br />as of the effective date of passage except for those explicitly <br />excluded by Section 218.02, Subd. 4. <br /> <br />. <br /> <br />6. Amendments and Circulation. The City may change, <br />delete, amend, or add to the provisions of this Personnel <br />Ordinance at any time in its sole discretion. Amendments and <br />supplements will be distributed to employees as new policies or <br />procedures are adopted by City Council.
