<br />. <br /> <br />. <br /> <br />. <br /> <br />.. <br /> <br />ORDINANCE NO. 90 - 12 <br /> <br />CITY COUNCIL OF THE CITY OF ELK RIVER <br /> <br />AN ORDINANCE AMENDING SECTION 218 OF THE CITY OF <br />ELK RIVER CODE OF ORDINANCES RELATING TO PERSONNEL <br />ADMINISTRATION AND POLICIES <br /> <br />The City Council of the City of Elk River hereby amends its <br /> <br />City Code of Ordinances and does ordain as follows: <br /> <br />Section 1. Section 218 of the Code of Ordinances is <br />repealed in its entirety. <br /> <br />Section 2. The Code of Ordinances Section 218 is <br />revised as follows: <br /> <br />SECTION 218.00 - PERSONNEL ORDINANCE <br /> <br />218.00 - Purpose. It is the purpose of this Ordinance to <br />establish uniform and equitable policies that will promote an <br />efficient system of personnel administration for employees of the <br />City of Elk River (the City). The provisions of this Ordinance <br />shall serve as a guide for administrative actions concerning the <br />City's personnel matters. They shall not be construed as <br />contractual provisions and do not establish terms of emploYment. <br /> <br />218.02 - Administrative Organization. <br /> <br />1. Intention of City Regarding policies and EmploYment. The <br />policies set forth in the Personnel Ordinance are unilaterally <br />created and implemented by the City and are intended to serve only <br />as guides for emploYment. The provisions of this Ordinance are not <br />terms and shall not be regarded or construed as contractual <br />provisions. The provisions shall not be interpreted as creating <br />anything other than an at-will emploYment setting. This means the <br />employee is free to terminate his/her emploYment at any time and <br />for any reason upon proper notice. The City may also terminate the <br />employee at any time pursuant to Section 218.08, Subd. 16. <br /> <br />2. Administration. The City Administrator is authorized and <br />directed, in accordance with his/her statutory responsibility, to <br />administer this Ordinance. The City Administrator may issue <br />administrative directives and instructions as necessary to explain <br />arid clarify the provisions herein and to facilitate their use. The <br />City Administrator may designate an assistant(s) to assist in the <br />administration of this Ordinance and to perform, under supervision, <br />any other functions which the City Administrator is authorized to <br />perform. In the exercise of the duties authorized herein, the City <br />Administrator may delegate to departments and supervisors the power <br />and duty to act on personnel matters within their respective areas <br />in accordance with the directives, guidelines, and instructions <br />
