<br />EXHIBIT H <br />GENERAL & SITE-SPECIFIC REQUIREMENTS <br /> <br />group business, disadvantaged business enterprise, or veteran-owned business goals, due to a lack <br />of good faith effort, more than once during the three-year period before submitting the verification; <br />I. the contractor or related entity is not currently suspended or debarred by the federal government <br />or the state of Minnesota or any of its departments, commissions, agencies, or political subdivisions; <br />and <br />J. all subcontractors that the contractor intends to use to perform project work have verified to the <br />contractor through a signed statement under oath by an owner or officer that they meet the <br />minimum criteria listed in clauses (1) to (6). <br /> <br />13.0 EPAct <br />The Energy Policy Act of 2005 (EPAct) created a Federal tax incentive under Internal Revenue Code §179D called <br />the Energy Efficient Commercial Building Deduction. This incentive encourages efficient construction practices. <br />While the tax incentive usually goes to building owners, public agencies cannot use it since they pay no income <br />tax. A special rule allows public agencies to assign the incentive to the designer who assists in the creation of <br />technical specifications for the energy efficient building features. If available, Client agrees to assign this tax <br />incentive to Contractor. <br /> <br />14.0 GENERAL SCOPE COMMENTS <br />A. Unless specifically noted in the Scope of Services – paint / patch is excluded. If noted in the Scope of <br />Services – only the affected areas will be addressed (not the entire area / wall). Paint will match <br />existing adjacent as close as possible, but an exact match cannot be guaranteed. <br /> <br />B. Piping / conduit / wire mold may be run exposed in occupied spaces (as applicable). <br /> <br />C. Unless specifically noted in the Scope of Services – conduit / wire mold is un-painted. <br /> <br />D. Some existing equipment may be left abandoned in place. <br /> <br />E. Unless specifically noted in the Scope of Services – no piping covers have been included. <br /> <br />F. If applicable - tile and carpet in-fill strips will match adjacent existing as close as possible but an <br />exact match cannot be guaranteed. <br /> <br />G. If applicable - existing ceiling tiles will be removed and reinstalled. New ceiling / grid is not included <br />in the Scope of Services unless specifically noted. <br /> <br />15.0 LIGHTING SCOPE CLARIFICATIONS: <br />A. The scope includes retrofit of the noted fixtures only and does not address or include any fix-up / <br />upgrade / replacement of existing wiring, switching, conduits, hangers, etc. If items are found to <br />need repair or replacement – this is not included in the Scope of Services and associated costing. <br />This scope does include replacement of existing broken lighting sockets when replacing bulbs. <br /> <br />B. It is assumed that all emergency lighting is on generator or independent battery control. <br />Replacements of emergency ballasts are not included in the project. <br /> <br />C. Replacement or repair of fixture lenses or louvers are not included, fixture lenses will be wiped with <br />a dry cloth. <br />EXHIBIT H Page 5 of 6 <br /> <br />
