W <br /> WASTE MANAGEMENT <br /> 9.10.7 Acceptance of final payment by Contractor shall constitute a waiver of Claims by the Contractor, <br /> except those previously made in writing and identified by Contractor as unsettled at the time of <br /> final Application for Payment. <br /> ARTICLE 10 <br /> Safety Precautions <br /> 10.1 Safety Programs <br /> 10.1.1 Contractor shall be responsible for initiating, maintaining, and supervising all safety precautions and <br /> programs in connection with the performance of the Work. Contractor shall submit a safety program <br /> to the Owner's Authorized Representative prior to mobilizing the Work, and shall be solely <br /> responsible for the safety, efficiency, and adequacy of Contractors ways, means, and methods. <br /> 10.1.2 Contractor shall submit a monthly safety report to the Owner's Authorized Representative which <br /> may be included in the job status report. <br /> 10.1.3 Contractor shall designate a responsible representative at the Site whose duty shall be the <br /> prevention of accidents. This person shall be Contractor's Authorized Representative unless <br /> otherwise designated in writing by Contractor to Owner. <br /> 10.1.4 Contractor shall follow Owner's safety rules, instructions and policies in effect at the Site during <br /> Contractor's performance of the Work. Contractor shall execute Owner's "Contractor's Health and <br /> Safety" form prior to performance of any Work at the Site and in the form attached to the Agreement <br /> as Exhibit B. <br /> 10.2 Hazardous Materials <br /> 10.2.1 In the event Contractor encounters on the Site material which it is reasonable to believe may be <br /> a Hazardous Material, Contractor shall immediately stop Work in the area affected and <br /> immediately notify the Owner's Authorized Representative and thereafter confirm such notice in <br /> writing. <br /> 10.2.2 If, in fact, the material is a Hazardous Material, the Work in the affected area shall not thereafter <br /> be resumed, except by Change Order or Construction Change Directive, and then only if such <br /> Work would not violate Applicable Laws. <br /> 10.2.3 If the material is not a Hazardous Material, the Work in the affected area shall be resumed. <br /> 10.2.4 Contractor shall not be required, pursuant to Article 7, to perform without consent any Work <br /> relating to Hazardous Materials except for those hazardous substances specified for use under <br /> this Agreement. <br /> 10.3 Safety of The Environment, Persons, and Property <br /> 10.3.1 Contractor shall take all reasonable precautions for safety and shall provide all reasonable <br /> protection to prevent damage, injury, or loss from all causes, to: <br /> .1 employees performing the Work or on Site, and other persons who may be affected <br /> thereby; <br /> .2 the Work including materials and equipment to be incorporated therein,whether in storage <br /> (on or off the Site), under care, custody, or control of Contractor or any Subcontractor; <br /> .3 work of Separate Contractors, if any. <br /> .4 other property at or adjacent to the Site, such as trees, shrubs, lawns, walks, pavements, <br /> roadways, structures, utilities, and underground facilities not designated for removal or <br /> replacement in the course of construction; and <br /> .5 Cultural, historical and archeological resources and the environment. <br /> 10.3.2 Contractor shall erect and maintain, as required by existing conditions and performance of the <br /> Agreement, all reasonable safeguards for the safety and protection of persons and property; <br /> including posting danger signs and other warnings against hazards, promulgating safety <br /> regulations and notifying owners and users of adjacent sites and utilities. <br /> 33 Jun-17 <br /> Ver.2.0 <br />
