W <br /> WASTE MANAGEMENT <br /> 10.3.3 Contractor shall recognize the environmental requirements of the Project. Disturbed areas shall <br /> be strictly limited to boundaries established by the Owner's Authorized Representative. Particular <br /> attention is drawn to the avoidance of any pollution of on-site or adjacent streams, sewers,wells, <br /> or other water sources. <br /> 10.3.4 Contractor shall use best management practices to minimize erosion of soil and excess runoff of <br /> surface or subsurface water from the Site, or wind-blown dust or erosion, during the construction <br /> period. <br /> 10.3.5 Contractor shall allow no burning on the Site, shall perform all Work in such a manner as required <br /> to minimize atmospheric pollution by dust or other contaminants, and shall control noise. <br /> 10.3.6 When use or storage of Hazardous Materials or equipment or unusual methods are necessary <br /> for execution of the Work,Contractor shall exercise utmost care and carry on such activities under <br /> supervision of properly qualified personnel. <br /> 10.3.7 Contractor shall promptly remedy damage and loss (other than damage or loss insured under <br /> property insurance required by Contract Documents)to property caused in whole or in part by the <br /> Contractor, Subcontractor,or anyone directly or indirectly employed by any of them,or by anyone <br /> for whose acts they may be liable and for which Contractor is responsible, except damage or loss <br /> solely attributable to negligent acts or omissions or willful misconduct by Owner, Owner's Design <br /> Professional, or anyone directly or indirectly employed by either of them, or by anyone for whose <br /> acts either of them may be liable, and not attributable to any fault or negligence of Contractor. <br /> The foregoing obligations of the Contractor are in addition to Contractor's obligations under Article <br /> 3.23. <br /> 10.4 Emergencies. In an emergency affecting safety of persons or property, Contractor shall act at the <br /> Contractor's discretion to prevent threatened damage, injury, or loss. Additional compensation or <br /> extension of time claimed by Contractor on account of an emergency shall be determined as provided in <br /> Article 7. <br /> ARTICLE 11 <br /> Insurance and Bonds <br /> 11.1 General Insurance Requirements <br /> 11.1.1 With no intent to limit Contractor's liability under the indemnification provisions set forth above, <br /> Contractor covenants to provide and maintain in full force and effect during the term of this <br /> Agreement and all extensions and Amendments thereto, at least the following insurance and <br /> available limits of liability. <br /> 11.1.2 If any of the following insurance is written as "claims made" coverage and Owner is required to <br /> be carried as an additional insured,then Contractor's insurance shall include a two-year extended <br /> discovery period after the last date that Contractor provides any Work under this Agreement. <br /> 11.1.3 "Aggregate"amounts of coverage, for purposes of the Agreement, are agreed to be the amounts <br /> of coverage available during a fixed 12-month policy period. <br /> 11.2 Insurance to be Provided by Contractor <br /> 11.2.1 Contractor shall provide at a minimum the insurance coverages and limits of liability set forth in <br /> the Insurance Requirements, Exhibit C to the Agreement. <br /> 11.2.2 Insurance may be in one or more policies of insurance, the form of which is subject to reasonable <br /> approval by Owner. Each liability policy shall have a contractual liability endorsement or <br /> otherwise provide coverage for any liability assumed by Contractor under the indemnification or <br /> other provisions of this Agreement. It is agreed, however, that nothing Owner does or fails to do <br /> with regard to the insurance policies shall relieve Contractor from its duties to provide the required <br /> coverage hereunder and Owner's actions or inactions will never be construed as waiving Owner's <br /> rights hereunder. <br /> 34 Jun-17 <br /> Ver.2.0 <br />
