W <br /> WASTE MANAGEMENT <br /> 6.3.3 Contractor shall promptly remedy damage caused by Contractor to completed or partially <br /> completed construction or to property of Owner or Separate Contractor. <br /> 6.3.4 Each Separate Contractor shall have the same responsibilities for cutting and patching as are <br /> described in Article 3.19. <br /> 6.4 Owner's Right to Clean Up. If a dispute arises among the Contractor, Separate Contractors,and Owner, <br /> as to responsibility under their respective contracts for maintaining the premises and surrounding area <br /> free from waste materials and rubbish as described in Article 3.20, Owner may clean up and allocate the <br /> cost among those responsible as the Owner's Authorized Representative determines. <br /> ARTICLE 7 <br /> Chances in the Work <br /> 7.1 Changes Generally <br /> 7.1.1 Additions, deletions, modifications or other revisions to the Work (collectively, "Changes" or <br /> individually a "Change") may be directed by Owner after execution of the Agreement without <br /> invalidating the Agreement and without notice to Contractor's Surety. Changes may be directed <br /> by Change Order,Construction Change Directive,or order for a minor change in the Work,subject <br /> to the limitations in this Article 7 and elsewhere in the Contract Documents. <br /> 7.1.2 Contractor shall proceed promptly to execute Changes unless otherwise provided in the Change <br /> Order, Construction Change Directive, or order for a minor change in the Work. <br /> 7.2 Change Orders <br /> 7.2.1 Whenever Owner and Contractor reach agreement upon the adjustments required as a result of <br /> any Change, such agreement shall be immediately recorded by preparation and execution of an <br /> appropriate Change Order stating Owner and Contractor's agreement upon the following: <br /> .1 Changes in the Work of Contractor; <br /> .2 the amount of adjustment in the Contract Price, if any; and <br /> .3 the extent of the adjustment in the Contract Time, if any. <br /> 7.3 Construction Change Directives <br /> 7.3.1 The Owner's Authorized Representative may, by Construction Change Directive, order Changes <br /> in the Work within the general scope of the Work and may state a proposed basis for adjustment, <br /> if any, in Contract Price or Contract Time, or both. <br /> 7.3.2 A Construction Change Directive may be used when Owner and Contractor cannot fully agree on <br /> the terms of a Change Order or pending agreement on the terms of Change Order. <br /> 7.3.3 Pending subsequent agreement to, or determination of, the effect on the Contract Price or the <br /> Contract Time, the Contractor shall proceed expeditiously with the Work as changed by the <br /> Construction Change Directive and the Owner shall make payments to Contractor on account of <br /> the Construction Change Directive utilizing the proposed basis for payment stated in the <br /> Construction Change Directive, if any. <br /> 7.3.4 A Construction Change Directive signed by Contractor indicates the agreement of Contractor to <br /> the terms thereof, including any adjustment in Contract Price and Contract Time or the method <br /> for determining them and shall be immediately recorded as a Change Order. <br /> 7.4 Adjustments in Contract Price. <br /> 7.4.1 Adjustments in Contract Price,whether by Change Order or Construction Change Directive, shall <br /> be based on one of the following methods: <br /> 1 mutual acceptance of a fixed price properly itemized and supported by sufficient <br /> substantiating data to permit evaluation; <br /> .2 Unit Prices stated in the Contract Documents or subsequently agreed upon; <br /> 24 Jun-17 <br /> Ver.2.0 <br />
