W <br /> WASTE MANAGEMENT <br /> have the authority and responsibility to act for Contractor and to represent Contractor. <br /> Communications given to the superintendent shall be as binding as if given to <br /> Contractor's Authorized Representative and the acts of the superintendent shall be <br /> binding on Contractor. <br /> .2 After Notice of Intent to Award and prior to beginning Work at the Site, Contractor shall <br /> furnish to the Owner's Authorized Representative, in writing, the name and qualifications <br /> of the person proposed by Contractor to be the superintendent. In the event Contractor <br /> identified a proposed superintendent during the bidding process, unless rejected by <br /> Owner,the proposed superintendent shall be the person previously identified. Contractor <br /> shall not assign as superintendant any person to whom the Owner's Authorized <br /> Representative makes reasonable objection in writing. Once an acceptable <br /> superintendant has been appointed, Contractor shall not change the superintendant <br /> without Owner's prior approval. <br /> 3.4.3 Contractor shall be solely responsible and have sole control over the means, methods, <br /> techniques, sequences, and procedures of construction, and for coordinating all Work under the <br /> Contract Documents. <br /> 3.4.4 Contractor is solely responsible to Owner for any acts and omissions of its employees, <br /> Subcontractors and their agents and employees, and any other persons or entities performing <br /> any portion of the Work for or on behalf of Contractor. <br /> 3.4.5 Unless otherwise specified in the Contract Documents, Contractor is responsible for all <br /> construction surveying necessary to complete the Work. <br /> 3.5 Labor <br /> 3.5.1 Contractor shall provide competent, suitably qualified personnel to perform the Work as required <br /> by the Contract Documents. Contractor shall at all times maintain strict discipline and good order <br /> at the Site. <br /> 3.5.2 Contractor shall prohibit its employees and the employees of all Subcontractors from possessing <br /> any firearms or illegal weapons at the Site or otherwise on Owner's property. Any person violating <br /> this rule may be removed from the Site, in Owner's sole discretion. <br /> 3.5.3 It is the policy of Owner to achieve a drug-free workforce and to provide a workplace that is free <br /> from the use of illegal drugs,substance abuse, and alcohol abuse. The manufacture,distribution, <br /> dispensation, possession (either externally or internally), sale, or use of illegal drugs by <br /> Contractor's or its Subcontractor's employees while on duty at or near the Site or the Project is <br /> prohibited. Contractor shall ensure that its and its Subcontractors' employees are prohibited from <br /> working at or near the Site or the Project while impaired by alcohol or under the influence of illegal <br /> or illicit substances. <br /> 3.5.4 Contractor shall comply with the employment eligibility verification requirements (Form 1-9) <br /> contained in the Immigration Reform and Control Act of 1986 (IRCA), and represents that all <br /> personnel engaged in performing Work have provided the required verification documentation to <br /> comply with IRCA and are authorized to work in the United States. Contractor understands that <br /> Contractor is solely responsible for this 1-9 verification and for any penalties or fees associated <br /> with Contractor's failure to comply with IRCA, and will indemnify Company for any penalties or <br /> fees imposed under IRCA against Owner on account of any worker providing Work. <br /> 3.6 Materials and Equipment <br /> 3.6.1 If required by Owner, Contractor shall furnish satisfactory evidence, including reports of required <br /> tests, as to the kind and quality of materials and equipment. Material not in conformance with <br /> Contract Documents will be rejected and shall be promptly removed from the Site at Contractor's <br /> expense. <br /> 3.6.2 All materials and equipment, including any materials or equipment purchased or furnished by <br /> Owner for incorporation into the Work by Contractor, shall be suitably stored by Contractor in a <br /> 11 Jun-17 <br /> Ver.2.0 <br />
