W <br /> WASTE MANAGEMENT <br /> safe, neat, compact, and protected manner in accordance with Applicable Law and any <br /> manufacturer's recommendations. Materials shall be stored in such a manner to cause the least <br /> inconvenience to adjacent property owners, tenants, and the general public, and shall not block <br /> access to any fire hydrant. Trees, lawns, walks, drives, streets and other improvements shall be <br /> protected from damage by the Work, materials, earth, debris, water, or otherwise. If private or <br /> public property is damaged by Contractor, it shall be restored to original condition or better by <br /> Contractor, in addition to Contractors obligations of indemnification. <br /> 3.6.3 Contractor shall obtain Owner's approval for storage areas to be used for materials or equipment, <br /> for which payment has been requested under the provisions of Article 9. Access to such storage <br /> areas,for inspection purposes,shall be provided to designated Owner representatives. Materials <br /> once paid for by Owner, become the property of Owner and may not be removed from the place <br /> of storage, except to the Site, without Owner's written permission. Contractor's all-risk insurance <br /> shall cover all perils including loss or damage to materials during storage, loading, unloading, and <br /> transit to the Site. <br /> 3.6.4 Contractor shall ensure that any drawings, plans and specifications for Contractor engineered <br /> materials or equipment included as part of the Work have been prepared and certified by a <br /> licensed professional engineer who has reviewed and approved all such drawings, plans and <br /> specifications, copies of which shall be made available to Owner within a reasonable time after <br /> Contractor's receipt of Owner's request therefore. <br /> 3.7 Products and Substitutions <br /> 3.7.1 For Products specified by reference standards or by description only, Contractor may provide any <br /> Product meeting those standards or description. <br /> 3.7.2 For Products specified by naming one or more manufacturers, with provision for substitutions (or <br /> equal), Contractor may submit a request for substitution for any manufacturer not named, <br /> provided that the progress of the Work is not thereby delayed. <br /> 3.7.3 When individual specification sections require a specific construction method orthe use of specific <br /> construction equipment, with provision for substitutions (or equal), Contractor may submit a <br /> request for any method or equipment not named, provided that the progress of the Work is not <br /> thereby delayed. <br /> 3.7.4 Contractor shall document each request for substitution with complete data substantiating <br /> compliance of the proposed substitution with the Contract Documents. A request for substitution <br /> constitutes a representation that the Contractor: <br /> .1 has investigated the proposed Product, method, or equipment and determined that it <br /> meets or exceeds the quality level of the specified Product, method or equipment; <br /> .2 will provide the same warranty for the substitution as for the specified Product; <br /> .3 will coordinate installation or implementation of the proposed substitution and will make <br /> changes to other Work which may be required for the Work to be complete, with no <br /> additional cost to Owner; <br /> .4 confirms that cost data is complete and includes all related costs under the Contract <br /> Documents; <br /> .5 waives any Claim for additional cost or time extension related to the substitution; <br /> .6 will work with Owner to obtain any required review or redesign services at Contractor's <br /> sole cost by a properly licensed design professional; and <br /> .7 will work with Owner to obtain any required reapproval and permits from Governmental <br /> Authorities necessary for the substitution. <br /> 3.7.5 Substitutions will not be considered or allowed when so indicated in the Contract Documents or <br /> implied on approved Shop Drawing or Product Data submittals without separate written request, <br /> nor will they be considered or allowed when acceptance will require revision to the Contract <br /> Documents. <br /> 3.7.6 Owner has authority to reject any request for substitution in its sole and absolute discretion. <br /> 12 Jun-17 <br /> Ver.2.0 <br />
