W <br /> WASTE MANAGEMENT <br /> Contract Documents, Contractor shall furnish and assume full responsibility for materials, <br /> equipment, labor, transportation, construction equipment and machinery, tools, appliances, fuel, <br /> power, light, heat, telephone, water, sanitary facilities, transportation, temporary facilities, <br /> supplies, and other facilities and incidentals necessary for the furnishing, performance, testing, <br /> start-up, and completion of the Work, whether or not incorporated therein. <br /> 3.1.2 Regardless of any inspections, tests or approvals by Owner, Owner's Design Professional, or <br /> third parties, Contractor shall perform and complete the Work in accordance with the Contract <br /> Documents. Owner has no liability or responsibility to Contractor or any Surety of Contractor for <br /> work performed by Contractor which is not in accordance with Contract Documents, regardless <br /> of whether discovered during construction or after acceptance of the Work. <br /> 3.1.3 Contractor shall not assign or transfer (other than by proper Subcontracts for which Contractor <br /> shall remain responsible) any rights or obligations under the Agreement without the consent of <br /> Owner, which consent may be granted or withheld in Owner's sole and absolute discretion. <br /> 3.1.4 Contractor shall verify that the Work is in conformance with the requirements of the Contract <br /> Documents before requesting observation or inspection by Owner. <br /> 3.1.5 Contractor shall give the Owner's Authorized Representative twenty-four(24)hours written notice <br /> before commencing Work or renewing Work where Work has been stopped for more than three <br /> (3) Days. Contractor shall also give the same notice to Owner's CQA Consultant, if any. <br /> 3.1.6 Prior to commencing Work, Contractor shall provide to Owner for Owner's consideration and <br /> approval a list of labor and equipment rates to be applied in any request for a Change Order <br /> under Article 7. Such list shall be all inclusive of trades and equipment Contractor anticipates <br /> utilizing in completion of the Work. <br /> 3.2 Review of Contract Documents and Field Conditions by Contractor. <br /> 3.2.1 Contractor's execution of the Agreement constitutes Contractor's representation that it has <br /> studied and compared the Contract Documents with each other and with information furnished <br /> by Owner pursuant to Article 2.1 and has reported to the Owner's Authorized Representative any <br /> discovered errors, inconsistencies, or omissions. <br /> 3.2.2 Contractor shall take field measurements and verify field conditions and shall carefully compare <br /> such conditions and other information known to Contractor with the Contract Documents before <br /> commencing activities. <br /> 3.2.3 Contractor shall make a reasonable attempt to understand the Contract Documents before <br /> requesting interpretation from Owner. <br /> 3.3 Conflicts, Errors,or Discrepancies. If Contractor finds any conflict, error,or discrepancy in the Contract <br /> Documents, Contractor shall report same to Owner's Authorized Representative in writing at once, and <br /> shall seek a written interpretation or clarification from Owner's Authorized Representative before <br /> proceeding with the Work affected thereby. Contractor's failure to comply with this requirement shall <br /> constitute a waiver of Contractor's right, if any, to seek an increase in the Contract Price or the Contract <br /> Time or otherwise recover any consideration on account of such conflict, error or discrepancy. Contractor <br /> shall be liable to Owner or to Owner's Design Professional for losses or expenses incurred by either of <br /> them resulting from Contractor's failure to timely report any conflict, error, or discrepancy in the Contract <br /> Documents if Contractor knew of should have reasonably known thereof. <br /> 3.4 Supervision and Construction Procedures. <br /> 3.4.1 Contractor shall supervise, direct, and inspect the Work competently and efficiently, devoting such <br /> attention and applying such skills and expertise as necessary,to perform the Work in accordance <br /> with the Contract Documents. <br /> 3.4.2 Superintendent. <br /> 1 Contractor shall employ a competent superintendent and necessary assistants who shall <br /> be in attendance at the Site during performance of the Work.
