W <br /> WASTE MANAGEMENT <br /> including any copies furnished to Contractor, are for use solely and exclusively with respect to the Project <br /> and Work. The Instruments of Service shall not be used by Contractor or any Subcontractor on other <br /> projects or for additions to the Project outside the scope of the Work without the specific written consent <br /> of Owner and Owner's Design Professional when applicable. Contractor and any Subcontractors are <br /> hereby granted a limited license only to use and reproduce applicable portions the Instruments of Service <br /> appropriate to, and for use in, execution of their Work under the Agreement or as may be required by any <br /> Governmental Authority in order to secure any necessary permits or approvals. <br /> ARTICLE 2 <br /> Owner's Riebts and Responsibilities <br /> 2.1 Information and Services Required of Owner. <br /> 2.1.1 Owner, assisted by the Owner's Design Professional when employed and by the Contractor, will <br /> complete an application for a building permit, as applicable for the place of the Project. Unless <br /> otherwise specified in the Contract Documents, the fee for such permit will be paid for by Owner. <br /> 2.1.2 Unless otherwise provided in the Contract Documents, Owner will furnish to Contractor one set <br /> of Contract Documents. Additional copies will be furnished on Contractor's request at the <br /> discretion of the Owner's Authorized Representative. <br /> 2.1.3 Unless otherwise expressly provided in the Contract Documents, Owner will provide Contractor <br /> with surveys and/or a legal description of the Project Site with any limitations and horizontal and <br /> vertical controls adequate to locate the Project. Construction surveying is the responsibility of <br /> Contractor. <br /> 2.1.4 To the extent practicable and reasonably available to Owner, Owner will provide contractor with <br /> access to any soils and environmental reports and geotechnical or other data describing physical <br /> characteristics of the Project Site. Owner does not warrant the accuracy of such information, and <br /> Contractor is not relieved of its obligation to investigate conditions on, under and around the Site <br /> by Owner's making such information available to Contractor. <br /> 2.1.5 To the extent Owner is required to provide information or services pursuant to the Agreement, <br /> such information and services will be provided by Owner with reasonable promptness to avoid <br /> delay in orderly progress of the Work. Unless a shorter time is provided for in the most current <br /> Owner approved Construction Schedule, information or services provided by Owner to Contractor <br /> within seven (7) Days of Contractor's written request therefore shall be conclusively deemed to <br /> have been furnished with reasonable promptness. <br /> 2.1.6 The foregoing are in addition to other duties and responsibilities of Owner enumerated herein. <br /> 2.2 Availability of Lands. Unless otherwise specified in the Contract Documents, Owner shall provide <br /> access to the Site on which the Work is to be performed, easements for access thereto, and such other <br /> lands which are designated in the Contract Documents for use by the Contractor. Contractor shall <br /> coordinate access with Owner's Authorized Representative. <br /> 2.3 Owner's Right to Stop Work. <br /> 2.3.1 If Contractor fails to correct Work which is not in accordance with requirements of the Contract <br /> Documents, as required in Article 12.2, or fails to carry out Work in accordance with Contract <br /> Documents within the time period for cure specified herein, Owner may order Contractor in writing <br /> to stop the Work or any portion thereof until the cause for such order has been eliminated. <br /> However, the right of Owner to stop the Work shall not give rise to a duty on the part of Owner to <br /> exercise this right for the benefit of Contractor or any other person or entity, except to the extent <br /> expressly provided elsewhere in the Contract Documents. Contractor shall comply with any such <br /> order and shall have no right to seek an increase in the Contract Price or the Contract Time or <br /> otherwise to recover any amount or make any Claim as a result of any such order. Owner's right <br /> to stop the Work is without prejudice to other remedies Owner may have, including its right of <br /> termination under Article 14.1. <br /> 8 Jun-17 <br /> Ver.2.0 <br />
