W <br /> WASTE MANAGEMENT <br /> 1.6 Execution, Correlation and Intent. <br /> 1.6.1 The Agreement shall be signed by Owner and Contractor as provided in the Contract Documents. <br /> 1.6.2 Execution of the Agreement by Contractor constitutes Contractor's conclusive representation that <br /> Contractor has carefully examined the Contract Documents, visited the Site of the Work, become <br /> familiar with local conditions under which the Work is to be performed, examined all available <br /> soils, geotechnical, environmental and other reports related to the Site or nearby lands, and fully <br /> informed itself as to conditions and matters which might affect the Work or costs thereof. <br /> Contractor further affirms that it has correlated its personal observations with requirements of the <br /> Contract Documents. <br /> 1.6.3 The intent of the Contract Documents is to provide for and describe the complete Work. <br /> Contractor shall provide all items necessary for the proper execution and completion of the Work. <br /> What is required by one of the Contract Documents shall be as binding as if required by all. <br /> Performance by Contractor shall be required to the extent called for by the Contract Documents <br /> or reasonably inferable from them as being necessary to produce the completed Work. <br /> 1.6.4 In the event of any inconsistency between the provisions of the Contract Documents, the <br /> inconsistency shall be resolved by giving precedence in the following order: (i)Amendments to <br /> the Agreement made after execution of the Agreement, (ii)the Agreement, (iii)Scope/Schedule <br /> / Price Form (iv) Supplementary Conditions, if any, (v) these General Conditions, (vi) other <br /> Exhibits to the Agreement, (vii) Specifications, and (viii) Drawings. <br /> 1.6.5 Reference to standard specifications, manuals, or codes of a technical society, organization, or <br /> association, or to laws or regulations of a governmental authority, whether specific or implied, <br /> shall mean the latest edition in effect as of the Effective Date, except as may be otherwise <br /> specifically stated in the Contract Documents. <br /> 1.6.6 No provision of any referenced standard, specification, or manual shall be effective to change the <br /> duties and responsibilities of Owner, Contractor, or Owner's Design Professional or their <br /> consultants, employees, or representatives from those set forth in the Contract Documents, nor <br /> shall it be effective to assign to Owner or Owner's Design Professional or its consultants, <br /> employees, or representatives any duty or authority to supervise or direct the furnishing or <br /> performance of the Work or any duty or authority to undertake responsibilities contrary to <br /> provisions of the Contract Documents. <br /> 1.6.7 Unless otherwise stated in Contract Documents, words which have well-known or customary <br /> construction industry technical meanings are used in Contract Documents in accordance with <br /> such recognized meanings. <br /> 1.6.8 In the interest of brevity the Contract Documents frequently omit modifying words such as "all" <br /> and "any" and articles such as "the" and "an"; but, the fact that a modifier or an article is absent <br /> from one statement and appears in another is not intended to affect the interpretation of either <br /> statement. <br /> 1.7 Specifications. <br /> 1.7.1 The organization of Specifications into divisions, sections, and articles and the arrangement of <br /> Drawings shall not control Contractor in dividing the Work among Subcontractors or in <br /> establishing the extent of Work to be performed by any trade. Contractor represents that it and <br /> its Subcontractors have examined all of the Contract Documents to determine the appropriate <br /> scope of Work for each. <br /> 1.7.2 Specifications are written in imperative and streamlined form. This imperative language is <br /> directed to the Contractor unless specifically noted otherwise. When written in the streamlined <br /> form, the words "shall be" are included by inference where a colon(:) is used within sentences or <br /> phrases. <br /> 1.8 Ownership and Use of Instruments of Services. Neither Contractor nor any Subcontractors shall own <br /> or claim a copyright or other right to the Instruments of Service or any part of them.
